Back-dated Rent Agreement

Respected Learned Colleagues:

I want to know if a back-dated deed of agreement is valid under the law?

In the instant case, the tenant has been a defaulter for the last SIXTEEN months, and no rent agreement was executed. Now the landlord wants to execute a rent deed starting from August 2008, when the tenant took possession of the premises.

I precisely want to know if a valid agreement can be made as of to-day, stating the fact that the tenancy commenced from August 2008?

The question is that the tenant is defaulter so how he will agree to sign a back dated agreement.
