Dear Experts,
One of my friends is convicted in section 307 case. He was previously out on bail after 2 months in jail.
We would like to know how can he get bail and how much time does it take to get bail in Section 307 case after conviction. Also if we appeal in High court in how much time does the accused get set free.

After conviction appeal has to be filed to the appellate court. Also file bail application. Allowing bail is discretion of the court and after conviction a bit difficult also. No time limit can be fixed. Consult some senior lawyer practicing in criminal law.

First of all file appeal before high court and therein pray to suspend the punishment till the disposal of the appeal and if this request is accepted, only then bail shall b granted.

With memo of appeal, you can apply for bail.

along with an application for suspense of sentence and an appeal, a bail application also can be filed, the bail application and the suspense of sentence application will be first taken, ofcourse there is no time limit to grant the relief under the applications, it is again the discretion of the judge.
