Bail in ni 138

There is order of Bailable Warrant worth Rs 10,000/- against me in a NI 138 case but the warrant hasn't been issued. I have sought time from court for bail. What legal procedure will I have to follow to seek bail when I appear on the next date. Please explain in detail. Thanks.

Dear kavindra
no need to wait for next date of hearing, if the warrant issued by the court the police unnecessary harass you, so appear before the court along with the bail application and surety and get the bail. No need to worry.

Such prayer of extension the time for bail is not a legal recourse and this is not available in criminal procedure code.

You require only one surity in such matter and the surity shall have to submit his property documents with surity bond mentioning therein that if the accused do not come present before the court on the dates fixed by it, the surity undertakes to recover the amount of bail out of his property, the title proof of which are being enclosed.

my younger brother has only a SBI STDR worth Rs 80,000/- in his own name. Is it enough to become my surety for warrant of Rs 10000/-?

Complainant need not come present at the time of the issuance of the warrant of the accused and blood relative is the best person to obtain bail being surity.

ur brother is best Surety/ Compl presence not necessary.
It is very easy, and 100% allowable, No worry.

if complainant present not necessary then why warrant ordered in January 2012 for issue in March 2012 not issued yet? (By God's grace) Its issue has been continuously postponed by the court for a whole year.

since I dont have a scanner at home I'm posting the exact words on the order sheet:

पत्रावली प्रस्तुत। पुकार करायी गयी। परिवादी की हाजिरी माफी प्रार्थना पत्र स्वीकृत। अभियुक्त अनुपस्थित है। अभियुक्त के विरुद्ध रजिस्टर्ड डाक से भेजा गया सम्मन लौटकर वापस प्राप्त नहीं हुआ है। नोटिस भेजे एक माह से अधिक का समय व्यतीत हो चुका है। वादी की तरफ से रजिस्ट्री रसीद दाखिल की गयी है। रजिस्टर्ड रसीद अवलोकन से स्पष्ट है कि अभियुक्त को पूरे पते पर स्पीड पोस्ट से सम्मन प्रेषित किया गया है। अत: अभियुक्त पर सम्मन का तामीला माना जाता है।

अभियुक्त के विरुद्ध अंकन 10000/- रुपये का जमानती वारण्ट दिनांक 20.01.2012 के लिये जारी हो। परिवादी वांछित पैरवी करें।
