I had taken a Broadband Connection from a company and give it a Rs. 20,000/- as non refundable amt. At the time of Demo the service was very fast but after insatallation of the same that became very slow and i was facing many problem with the service like non compliance of grivences in time, slow speed, frequently disconnection etc.... at last I had wind up that connection... and instituted a case u/s 12 consumer protection act. So that my problem is this should I demand non refundable amount (I have signed a document regarding this) because of deficiancy of service. Is thare any case law??

it depends on the terms of the agreement you entered with the compnay, hope you have that document with you

The citation on deficiency of service are available in numerous number. Refer to CLT 2008 (3) wherein citation on almost similar subject is available.

Yes you can demand non refundable amount because you gave that amount on assurance that they will provide you good services in future. They are liable to pay compensation along with the amount you spend, but burdon of proof will be on you to prove their deficient service.

You can file case and Claim the non refundable amount 20,000/- as the deposit contemplated some services , the same are not complied by other side , the Condition - non Refundable- has no force / can not be enforce by other side -

U can dedmand for the non refundable amount which u have given. When there is breach of agreement by the network they are bound to refund with interest, because they use the money.
Regarding def., of service number of citations are available and ur case is good case of negligency by the network.
