Giving under construction property to my wife

I booked a commercial property on my name. The property is under construction. Possession has not been given by the builder yet.

How can I give this property to my wife? Objective is to make my wife the owner of the property. I don't want to own it.

Gift deed?
Relinquishment deed?
Transfer?

Should this arrangement be done with the builder or at registrar or in court?

Builder is charging extra money per square foot for transfer.

Is relinquishment deed, which costs much less, applicable/possible in this case?

share to Daughter from father property

If the father has 2 wifes and 1 dead (has 1 son) - 1 alive (has 2 children - 1 male and 1 female).

If father has made the entire property in the name of the 2nd wife.

Does 1st wife son and 2nd wife daughter gets the property share by succession.

conveyance

Hi all, i have purchased a resale flat where society conveyance is not given by builder because he still has not sold one of the flats in the society. building was constructed 5 yrs back. pls let me know whether in this case, can conveyance be obtained from builders and if so, on what basis. thanks.

But what if builder doesnt sell one of the flats that he owns. In that case how would i get conveyance.

termination of lease agg.

We have given some land on lease to a Pvt. Lim.company. Now the company has changed its name and also the directors.
There was clause in agg. that the lesse shall not transfer or sublease the land without written consent of lessor and we were not even initmated in this case
Can we terminate the lease of land.??
What action we can take against both old and new company/directors.??

1% VAT taxation in Maharashtra

Hi,

The Maharashtra goverment has come up with the new 1% VAT taxation for all the Flats Registration done on or after 1st April 2010. My query is before 1st April 2010, did the taxes for the sale of the Flats were borne by the builder? If yes what was the tax percentage? and also why the 1% VAT tax has now to be borne by the buyer? I am asking this question, because recently i did my flat registration and the builder has asked for the 1% VAT check in the name of the builder. Also my registration was supposed to happen on 26th March 2010, but the builder delayed it intentionally and pushed it to 9th April 2010. My query is by postponing my flat registration, does the builder gain in any way? for i know i am at loss as i have to now pay extra 1% VAT on the sale agreement amount.

Your prompt response would be greatley appreciated.

Provisions of IPC

Respected Seniors,

Two brothers namely X &Y jointly purchased a property. It is purely self acquired property of the said Brothers. The said two brothers and their wifes are died intestate. After some years only son of Mr. X created a gift deed infavour of his Son (ie grand son of Mr. X) with regarding to the above said property. There in he mentioned as there is no children to Mr. Y. In fact Mr. Y have a daughter. She claimed half share of the said property and also she wants to prosecute son of Mr. X since he created a false document in favour of his son by concealed the facts. What are the sections applicable to the said problem under I.P.C. to prosecute the son of Mr. X.

Transfer of flat in co op soc

We want to tranfer the flat in co op soc in our name [3 brothers]. The flat is in name of our late grandfather. The society is dealying the matter. A person [friend] has adviced us to obtain succession cerificate and submit to society.
What is the procedure for it in mumbai. what is total cost involved icluding lawyers fee court fee? And the min. duration taken.

rights of heir

My father died leaving hehind flat.No will,nomination prepared by my father.So we obtained hiership from court on my mothers name. Society transfered flat on my mothers name.Now my question is can my mother sell or gift flat to anybody. What are the rights of heir as she is the only trustee of the property.

Member of a Co-operative Housing Society

One member of a co-operative housing society has given his flat on rent. He is not staying in that society but he has given his name for becoming committee member of the society. Can that person become member of a committee even if he has given his flat on rent and he is not staying in society. (he has given his name only for becoming member of the committee and not for chairman or secretary or tresurar). Please advice
