Mortgage

Sorry Friends, I am again posting the same question that I have posted in Forum at this site.

We have intended to obtain loan on Mortgage by deposit of title deeds (Equitable Mortgage) from our Bankers. The immovable property is situated at a village in Maharashtra. We seek your legal advise on the following points: -

01. Whether the Mortgage by deposit of title deeds attracts stamp duty?

02. Whether registration of the Mortgage by deposit of title deeds is mandatory?

03. Can we execute Mortgage by deposit of title deeds of immovable properties of Maharashtra at another location i.e. Delhi / Ahmedabad ? (Our and Bankers offices situated on both places).

A & B ARE HUSBAND AND WIFE. IN 1979 ( DELHI) ONE PROPERTY IS PURCHASED. IRREVOCABLE GPA IN FAVUR OF A AND REGISTERED WILL , RECEIPT, AVIDAVIT IN FAVOUR OF B. B WAS HOUSE WIFE. 1,2,3, AND 4 CHILDREN OF A &B. 1 @ 4 DAUGHTERS AND 2 & 3 SONS. A LIVE SEPERATELY SINCE 1995 GIVING MANINTENCNE TO B BUT NO JUDICAL SEPERATION WAS DONE. A DIED IN 1999. B ALONGIWTH 4 WANT TO SELL THE PROPERTY AFTER GIVING 30% SHARE TO 2. 1 IS MARRIED. B ASK 3 TO LEAVE THE HOUSE AFTER GIVING LEGAL NOTICE HENCE 3 LEFT THE HOUSE 1 YR BEFORE. Registered will, receipt & affidavit was made by the seller of the property to the purchaser (b).

IS THERE ANY REMEDIES FOR 1,2 AND 3. WHETHER THEY FILE SUIT FOR POSSESSION OR PARTITION.
ANY LATEST CASE MAY BE INTIMATED FOR HELP

Dear Sirs, In a decree against JD,can EPF and PPF be attached on withdrawl after retirement ? Can Gratuity of an Employee be attached. Kindly enlighten with provisions of law. Thanks Suresh

I m Musilm. Query is whether property inherited by my grandfather can be transfered to my father by muslim law?
Or according to wish of my grandfather it could be given to any of his child & not equally to all his child?

Please let me know is MUSLIM PERSONAL LAW APPLICABLE TO agricultural land transfer by will?

reduction of the auction money

sir in a final digree of civil court the property was purchased by one party at the cost of RS 95 Lankhs.

but the actual value of property is farless the above value.

is there any provision which provides for reduction in the value of the property.

Please tell me that if a landlord is having a alternative property in which he can run his business effectively can made its tenant to evacuate from this property in which the tenant is getting his livelihood only on the basis that landlord want to run his business form that place which is not in his bonafide interest?

Daughter Right in the Property of Father

Hi,

We are having House which is build in the property of my mother father. My mothers father is expired but my mothers Borther is objecting for any construction works or any other works related to property.

My mother has not register her marriage, and we cannot find her birth reistration. My father is expired.

Under what section can I costruc or do any work on the propery based on right of daughter in the property of father.

Can I sucessed, what I have to do to divide the property without availability of documentary evidence.

Regarding suit for possession and damages

My father died intestate suddenly during 1989 leaving a property in Delhi having built up three floors. There are three legal heirs including widow mother. In one of the floor I am residing alongwith my family. My sister wants to grab entire property through my mother for which on her provocation my mother filed a suit for possession and damages against me on the basis of a Will in a plain paper. My father died at a very young age suddenly. In another case due to their ill-intention I had filed a suit for permanent injunction in which decree granted to me and bother the two legal heirs given in writing in the court that they admit my possession and will not try to dispossess me. In view of the above facts, please advise me on the following querries:-

1. Can suit for possession and damages filed against me still have any merits or it will now be rejected automatically by the court.
2. Can my mother is entitled to file the suit for possession and damages against her own child who is one of the legal heir of the property.
3. What are the main conditions for filing suit for possession and damages and what kind of further course of action is required to be initiated by me.
4. Relevant court judgement on the above cited subject matter.
