two accused persons were tried for an offence u/s 379 r/w 34 ipc. 2 nd accused was im- plicated on the basis of an alleged confession of 1 st accused.how far ths confession admissible, especially when recovery was effected from 1 st accused ?

The case of filling petrol without payment.

Accused went to petrol pump station and asked the man to fill the petrol. The man filled the petrol and after that the accused went away with his car without payment.Will it be a case of thief?

PROBATION OF OFFENDERS ACT


ACCUSED WAS A LADY AGED ABOUT 25 YEARS CHARGED U/S 381 IPC.SHE WAS FOUND GUILTY AND A REPORT OF THE PROBATION OFFICER WAS CALLED FOR. PROBATION OFFICER GAVE REPORT STATING THE PATHETIC CONDITION OF THE ACCUSED, IN ALL RESPECTS ,AND PLEADED FOR COURT"S MERCY. BUT THE COURT OVERRIDED THE REPORT AND SENTENCED THE LADY TO 3 YEARS RI.
WHETHER THE SENTENCE LEGAL ?
WHAT IS HER REMEDY AT APPELLATE STAGE ?

457 INDIAN PENAL CODE

ACCUSED COMMITTED THEFT IN HOUSE AND WAS ARRESTED 3 WEEKS AFTER FROM ANOTHER PLACE STOLEN ARTICLES . AND, HE WAS CHARGED U/S 457 380 IPC.HOW HE CAN BE PROSECUTED U/S 457 IPC AS THERE IS NO LEGAL EVIDENCE TO THE FACT THAT HE HAD TRESSPASSED INTO THE HOUSE BY NIGHT,APART FROM HIS CONFESSION.

what is the diffrence between documents marked and documents exibit and document on record in court file at any proceedings, how the document is marked if submitted as annextures or exibits, i mean the process to get the documents marked and at which stage?

How can we differentiate the appeal against acquittal and revision against acquittal?

private defence:

Can there be a plea of private defense in the instant case? A and B were the only survivors of a ship hanging on a wooden plank.Suddenly they realized that the wooden plank could hold only one person.A gave a hard blow on B and as a result B was drowned in the ocean and A survive. A was charge of murder of B. Can A plea a case of private defense?

Judge witness a crime:

If a Judge saw A committing a crime but in the trial before him the prosecution proved the guilt of the accused against B, should the judge convict B, despite the fact that he knew that A commit the crime?
