The details of case are follows
Wife is staying abroad for the last over 8 years & still continue to be abroad. Not even visits India, even if she arrives for a week or so she stays at her mother's place without giving any intimation to husband about her arrival or departure too. he comes to know about the same, after a long time. In such a state, husband thought calling her upon the wife to live a life together & sent a legal notice by RPAD to her London Residence, which was received by her, asking her to come to india & stay together, but she did give a vague reply to the same denying the facts whatever stated in the legal notice.So the husband filed the case for the same. Subsequently the suit summons sent to her by RPAD has not been served neither returned to the court at India & the memo to publish the notice through paper publication in London newspaper was put forth in the court for permission, but the court denied to allow the application stating the reason of jurisdiction. so my question is what is further remedy to serve the court notice or is there any case laws which can help me to get the divorce of my client, exparte.
in One of my case against the wife for divorce matter, she has accepted the legal notice, while she was at London & after filing case for divorce, the successive notices send to her were not served upon her nor returned to the court. So can you please suggest alternative to serve the summons upon her or any other case laws for granting of divorce to husband without serving notice as the husband resides in India having poor background & cannot reach his wife at London, as she was sent to work over there but presently she is avoiding him too much & do not care to talk or call him also. Can you suggest any remedy for this. thanks in advance.

When a will is executed jointly and mutually by a husband and wife ,whether the will comes into operation immediately even when one of the testators to the will die ? Can the Will be revoked by any other living testator ? Any case laws on the above subject

I have an unfortunate situation before me please help me............my grandfather has five sons my father being the eldest. all are engaged in different businesses we have a joint family no formal or informal partition has been done....every male member (my grandfather, father, uncles) have formed HUF and file IT returns for HUF & individual.
the family properties are owned jointly as well as individually by different members including me.
one of my uncles(A) who does business from a shop owned by my grandfather (he does not have any other income from job etc) he(A) has another shop on his name individually he says this shop is on his individual name n this will not be included in family partition everyone else is against this he(A) will not listen to any elders ,relatives regarding partition he(A) intimidates my grandfather so a will by my grandfather is very rare possibility.......
the properties have been purchased from time to time by joint family money based on availability of capital on a members books of account.......other members have properties individually too but agree that all properties are joint family properties regardless of owners name (all properties were purchased by mutual consent) ........... what should me or my father do? please advice……

Hi. I had been married in Aug, 2008 to a middle class girl. At the time of marriage her dad told me that she is very good at house keeping, cooking and in speaking in English. But, later when I had to move to Goa for job, I realized that she doesn't even know how to cook rice and clean the house.
From then onwards, she and her parents are making repeated allegations that I am having an extra-marital affair with a servant - which is completely false. They are even insulting my parents and friends. She went back to her maternal home 2 weeks back. Last week when I visited her house to see her, her dad told me that if I need to see my wife, I need to clarify why my mother is calling their relatives and enquiring about my wife's character - which is a lie.
Now, he is threatening me in ugly language to clarify the comments made by my parents. Of which, none are true.
After moving to Goa, my wife repeatedly accused me of marrying without her consent. She called her parents and lied them that I am beating and torturing her. She herself wrote letter to me stating that she wants to leave and doesn’t want to re-unite. And now, after she went to her parental home, she is spreading all the lie stories again.
Please tell me what to do.
I had filed a Succession O.P. for want of a Succession Certificate but i am not in a position to pay the Court Fee at present but i will pay it on or before issuance of Succession certificate but the Hon'ble Court is not considering the same plz i am need of citations which ever related to the exemption of the Court Fee while filing the O.P.
Sir..a govt employee (54yrs) died due to sickness, leaving his wife, two unmarried sons and a married daughter. legal heir certificate given by tahsildhar is carrying these 4 people names. Before death, he got jewel loan in IOB (pledged his wife's gold jewels). Now, that family wants to redeem the jewels by paying the o/s loan amt. but the manager asks them to add deceased man's mother's name in legal heir certificate. But their ration card doesnt have his mother's name as she lived seperately with her husband. Is it must to add his mother's name in legal heir certificate?
Passport

Our clients got married and registered their marriage in 2004 and also obtained passport from the concerned authority in the same year i.e 2004. They separated legally by filling divorce petition u/s. 13B of HMAct and order passed in 2006. Again they got married in this year bt till they hv not registered their marriage.
My question is whether they can get visa form their old passport or they should apply for a new and fresh passport
