what is the effect of setting aside an exparte order of divorce petition?
The husband had filed a petition under section 13[1a] of Hindu Marriage Act. The wife did not appear before the Court and though due notice was served a paper publication was taken for the same. The wife remained absent and the Hon'ble Family Court allowed the husband's petition.
The wife filed a miscellaneous petition and set-aside the exparte order. The wife filed one more petition for conjgal rights and in that petition the husband remained exparte. It was allowed.
Presently, the husband has filed a miscellaneous petition to set-aside the exparte congjal rights.
The issue here is the status of the spouse and the litigation is for 10 years.

if a man & a woman live together for a long period of 10/20/30 years without gettin married ,i.e.,cohabiting & they have children out of that cohabitation.will they be given the status of husband & wife after a long period of cohabitation? will their children be considered legitimate children?

Dear All, please let me know- Let me know the procedure to adopt a child aged about 10yrs.
Facts- 1. child's mother has given her consent for adoption of the child. 2. Husband (child's father)is not living with them(with wife & kid)since 4yrs.
Query- 1. what would be the rights & liabilities of the person who is going to adopt the child.2.In future can the father(child's father)claim his rights.

husband filed an application for divorce against his wife on the ground of sexual torture by wife. is there any reported cases high courts or supreme court as it is cruelty? please guide me. wife is pressing sex irrespective of time she wants sex without taking into consideration of the health (an application is filed by husband pending)

Hi,
My cousin sister aged 40 years is married and doesn't have children. Her husband want to marry another girl to have children and is forcing my cousin to accept for this proposal. She is against for this proposal and suggesting to go for adapation. However her husband and their family members are harassing her to accept for second marraige and have finalised plans for second marraige. Can you suggest what my cousin should do in these circumstances.(She does'nt want to separate from her husband)

i am wirting on behalf of my sister, she hasbeen married to an army personal, presently working as ADCto the governer of Raipur( Chhatisgarh) at the time of marriage it has been agreed that she will will be working at the places as per her posting , she is working as manager,but when husband become ADc he wanted her to join immidiatley, but as she is holding a responsible in private sector, she cannot move, as the Husband is an Adc he file a case of divorce putting false aligation on her, she was having a small kid of six month and he was around two to three months when the case was filed so she was unable to move to attend the court in raipur, we filed a petation was filed in supreme court for the transfer to case to pondycherry, but before the date of the supreme court the judge ther given experte and pass the order, so we want whta to do now, it is very very urgent as the order is passed on 1.07.08. please give us the needful suggestion otherwise he will will be just resque, as he is an adc so he may use his power, i have a small baby, i have to take his care, i am working in private company, my hauband never helped me with a single penny when my baby was born, and what he did he filed a case.
