Hi,
I have observed the following things during my case. The court staff are now a days completely corrupted and can do anything for 100 bugs. Pls let me know what action we can take on these staff.
1. The submitted documentary proofs were replaced by some duplicates.
2. The orders were not given on time.
How can one do in such cases?

When DIVORCE needed but avoided (by wife) and delayed (by Indian court)?
I really don’t have anything against my wife, still have respect for her. In the beginning (1994) – I was much immature (perhaps in emotion and man woman relation till date) and due to some ego from my side, the distance made between us. And it was keep on increasing in several way in many forms. I tried many times to compromise and adjust- but I couldn’t. Several women came in my life (no one through professional life). Now I am realizing, before it’s further late for both of us, it has to be done. We are sleeping in different rooms last 13 months, didn’t intercourse last 18 months (not more than 6 in last 3 years). But I cant live in this manner anymore. I am regularly taking drugs for sleeping, pressure and cholesterol and ant depression as prescribed by physician. Before it affects my job performance, I want to end it. I can take everything else, but not a bad performance of myself at workplace.
1st I want to change my marital status. I can’t act anymore everyday in home, and want to be fair at least this time to my wife. I know lots of odds will come from my mother and relatives. I have to shift for a separate residence (like I did in July 2008), might face financial crunch also. But still I have to do this, my mother is also suffering last few months, guessing my mental condition, and unfortunately in spite of my trying - relation between wife and mother isn’t healthy yet. My wife stopped using Sindoor. I am 40 now, so still have some courage left. But after this it wont be possible. Even in my professional life, people wont take it easily. Still I want to take my own black spots, my failure- to the public, at least to the people who matters; cant play hide and seek game anymore. I stopped myself several times; thinking about my son, but truly speaking he almost doesn’t have any emotional relation with me. Its all my fault, as he saw, his mother is away from me- he also started maintaining a distance. So, please don’t say me to rethink this time. The issue was already pushed for 10years- but nothing changed. I shall fulfill all their (wife and son) other need like now, but not by staying together anymore. I know healthy parent relationship is essential for kids to grow. But the way I am living is not a healthy way, staying apart is a far better option surely.
Feelings of two human beings are involved in a couple’s married life. This could not be patched up by enforcement of law by courts. It is up to the individuals to mend themselves. A horse can be taken to water but it is the horse that should drink it. However, the law should not deny divorce if the marriage has really broken down. By forcing unity with a hammer in the hand, the law does not serve the sanctity attached to the institution of marriage by religions.
If the relationship of husband and wife wrecks beyond repair, what is wrong in recognizing that fact and allow them to live separately. How can one compel a wife or a husband to continue to live with spouse if they have fallen apart? If so compelled they would have to lead miserable life.
My wife knows all of these but still not ready to divorce me- "just for my son” and her status to society! How to tackle her and HONURABLE INDIAN COURT?

My wife has submitted petition in Kalyan Court against me for PODGI (Maintain ace) u/s 125 of Hindu law & again submitted petition in pimpri court also u/s domestic violence act for PODGI
Presently I am jobless I am doing part time job for accounting I am getting Rs. 6000 to 8000 per month
In her petition she demanded PODGI for 17000 per month for herself & my one child. She is looking after the child since last two years. She stay with her father but in her petition she say that she has been living separately from her father & submitted photocopy of leave & license agreement of rent . she is trying to show that she has been paid rent of Rs. 3000 . she is not doing any job & how can she live separately ?
I have aquired property at pimpri for Rs. 25 lac in name of me & my father
On above basis can I pay more PODGI to her?
How much PODGI I should pay her?
Can any one explain above queries reply

Case filed under DVPC (domestic voilence act) by wife against husband who is drunkard and violent.Husband subsequently agrees to transfer all his property to his minor children with himself and his wife becoming minor guardians.Question is: under this act can a decree be obtained by the court to transfer property in minor childrens name by both parties filing a compromise to this effect.

Respected Lawyers,
My wife has got divorce in lower court - civil senior division and I want to challenge this order in its upper court - district court. She has not filed the case in family court else I would have to appeal in high court but in this case since civil court has given the decree, I would like to know what is the appeal period for district court in divorce cases. Generally for appealing in high court it is 3 months but for district court what is the period of appeal?

We got married on 30th May 2008 and my wife hardly stayed with us. In the month of 0ct 2008 without informing any one of us left our home and on 11th nov 08 sent a legal notice cliaming maintenance under 125(1) saying that i throw her out of house which is falls and we replied asking her to come back. But in the month of march09 she filled a case under 125(1) and the petition says that my parents and me had harassed her for dowry which she and her mother cliams is false.
She also cliams that she was not given sufficient food to eat by my mom which is falls since my mom was in canada after our marriage for my sis delivery.
All this is happening bcoz she wants only money and nothing else
once she openly told me that she married me only for the sake of money and property. She was not interested in marraige and her mother forced her so that she can extract money from me. The root cause for all this is her mom who works for women welfare org. Since i have a solid proof abt all the evil deeds of hers i want to now how can i come out of the case without paying single rupee to her.
I also want to now if there r any chances of her filling case under 498.
the petition copy clearly says that she is only for money and nothing else.
Pls suggest what i can do

A marries B who is A's brothers widow. is this marriage valid marriage acc to hindu marriage act 1955? or it cover under the coustum of punjab?

I am Assisting the prosecution for offence u/s 498-A against the my client' s husband, and also I have filed divorce petition against the husband. The main allegation that the husband is the impotent and treating the wife in cruel manner.During the trial in the criminal case, the wife has deposed that she is a Virgin. Now the husband has filed a petition seeking direction from the court to send wife for virginity test. The petition has been filed without stating any legal provision. Kindly guide me in this stage.The wife is not agreeing for the test,.

1. Is it mandatory for both parties to follow the consent order passed by the court?
2. Is it possible to file and appeal against a consent order?
3. If any party goes back on the consent order then in that case the court nullifies this consent order or modifies the consent order taking into consideration the concerns of one or both the parties?

Changing father's name in DOB certificate
Sir, unfortunately our relatives made a mistake in my child's date of birth certificate. At present my child has 3 years old. So, I want to change the father's name in my child's date of birth certificate. Regarding this would you please suggest me the solution... here are I am mentioning the details in my child's birth certificate:
Father's Name: A. Rajasekar
Mother's Name: A. Swapna
I want to change these as,
Father's Name: S.Anjaneyulu
Mother's Name: S. Swapna
