Dies non

I was transfered during pandemic on the basis of nativity, to a place which is 400kms far away from my present location. So applied for leave, but rejected , and now showcased , to treat my leave as dies non. Due to pandemic, can I submit any reasons to my unauthorised absence

Applicability of cooling off period -reg.

Sir,
I proceeded for deputation (ISTC) from my parent Department (one of the Major port of India) for 3 years. While my deputation period was about to end, one post (Executive Engineer) was advertised by one of the Major Port of India on Composite Method i.e. Promotion/Deputation/Absorption basis. In the application form they asked to tick the option that on what basis the applicant want to apply i.e. Deputation or Absorption. I filled the application by opting Absorption Basis and submitted the same to the Competent Authority for onward forwarding to the department who advertised the post. Subsequently, i have joined duty to my parent department after completion of my deputation tenure of 3 years. Same time my application was also forwarded to the other Major port including all the clearances i.e. Vigilance, Administration etc. Now after completion of everything, my department is telling that your application needs to be withdrawn as i am under cooling off period and i have to wait for 3 years for completion of cooling off period. My understanding is that the cooling off period is applicable for between 2 deputation not for direct recruitment or absorption basis recruitment. I need immediate help in this matter with some documentary evidences please. Also Please put some light on the above matter. I will be thankful to you.

Office premises two employees were quarreled - reg

Respected Sir/Madam,
1. In our Company two employees were quarrelled (Shri.Gupta age 59 Yrs and Shri.Rajan Age 37 Yrs).
2. During the incident, when Shri. Gupta came out from his cabin and attacked to Shri. Rajan, in the attack Shri. Gupta caught hold of Shri. Rajan neck and pulled his Identity card. Immediately Shri. Rajan by protecting himself Shri. Rajan pushed him aside. Due to which Shri. Gupta fell down on the other side window edge, in this course of action small head injury happened to Shri. Gupta and blood whooshed to Shri. Gupta.
3. On the same day 15 minutes before to this incident Shri. Gupta discussing with other co-employee Shri.Satish that he will damage the name of Shri. Rajan and he was abusing Shri. Rajan with bad words.Shri.Satish approached HR Department and told that Shri.Gupta scolding Shri. Rajan with bad words in front of others. After listening Shri. Satish Complaint Shri. Rajan trying to approach Plant Head for submitting his complaint against Shri. Gupta during the course of action Shri. Gupta came out from his cabin and attacked Shri. Rajan as mentioned above. The entire episode recorded in CCTV footage.
4. Shri. Gupta is a Officers Association elected member and Shri. Rajan is a HR team member. Being a Officers association elected member with the political influence Shri. Gupta always troubling all the other co-employees including C&MD of the company. When incident happened to C&MD that time an FIR also filed against and disciplinary actions initiated against Shri. Gupta.
5. The Management initiated disciplinary action and served Charge sheet for both employees.
Now my query is Management is required to consider Shri.Gupta past behavior as mentioned in the point number 5 and 15 minutes to the incident behavior for disciplinary proceedings as mentioned in the point number 3 , as Shri.Gupta influencing politically and trying to punish Shri. Rajan.

Relieving letter

I am working in a medical college and i have applied resignation recently. I offered to pay 3 months salary as per MOU and also serve 3 months notice period. But the management is threatening that the relieving letter and my original certificates will not be given till proposed NMC inspection is over (Even they dont know when it will happen).
What can i do.. Anyone plz suggest.......

Transfer of employees while on medical leave

I am working as Clerk in haryana government. I am on Medical Leave but my officer willing to relieve from his unit to next unit as I am also under transfer to the next unit. Is he legally relieved me to next unit while I am on Medical Leave.

Annual leave balance

My company is asking me to go on LWP since the business is not good. I had 35 days AL balance as on March 2020. Out of which they made me apply for 29 days which I could not take nor they paid me. Now when I am asking them to pay me they are saying it's only 6 days. Can someone through some light. As per the polisy it says " Annual leave can be accrued to a maximum of 45 days at any given time. Only upto a maximum of 45 days at any given time. Only upto 6 days per year can be carried forward for accrual".

Reinstatement in services on quashing of fir

Dear sir a false FIR WAS REGISTERED against me and due to this my services during probation were terminated. The link of that query is as under

my current employer forcing me to buyout the notice period!

I am to join my future employer in 2 months as my notice period at my current employer is 2 months. However when I put my papers, My current employer is saying it will release me and I HAVE to buy out the notice period of 2 months! I am not comfortable doing so and I want to serve my full notice period as I am to join the next employer in 2 months
As per my offer letter, The Notice period and Termination clause is as follows
"After confirmation of services, either party may terminate the employment by giving a minimum of 2 months notice to the other party. The firm may, at its discretion, with or without conditions, agree to waive off this notice period requirement of 2 months either wholly or partly"
(There is no separate buyout clause)
Can the employer ask me to BUYOUT the notice period when I wish to serve the same?!

Consequences of opening ca office during lock down

Presently in Karnataka it is LOCK DOWN. Chartered Accountant service is an not essential service during lock down. So if the office opens & caught by police or Labour law department under which ACT & Which Sections they can file cases. What is the proof they can get?
