Applicable tds on nri selling property

HELLO TAX EXPERTS
FIRST OF ALL THANKS TO ALL FOR YOUR CONTINUOUS SUPPORT.

QUERY IS :
A NRI IS HAVING A RESIDENTIAL PROPERTY IN MUMBAI, WHAT IS THE TAX IMPLICATION ON HIM


AS I UNDERSTAND THERE IS NEW RULE OF 1% TDS APPLICABLE, IS THIS THE LIABILITY OF THE BUYER TO DEDUCT 1% OF THE CONSIDERATION VALUE AS TDS

SECONDLY AS SELLER IS NRI THERE IS TDS APPLICABLE ON "NRI SELLING PROPERTY IN INDIA". IS THIS AMOUNT ALSO RESPONSIBILITY OF THE BUYER TO DEDUCT TDS AMOUNT.

ARE THES T.D.S. SHOULD BE BEFORE REGISTRATION OF THE PROPERTY OR AFTER REGISTRATION.

Can a nri or foreign resident indian can become trustee in indian trust

I WISH TO KNOW IF A NRI OR FOREIGN RESIDENT INDIAN CAN BECOME TRUSTEE IN A PUBLIC TRUST IN INDIA.

sec195 of I T Act

when a resident remits any amount to a foreign client in his usual course of business say for fair stall rent will TDS will be applicable.? what will be the treatment when the NRI belongs to acountry which has DTAA with india. how to ascertain that NRI to whom amount is being remitted is a company or not. moreover if resident remitting the money has shown the expense in his P & loss account will TDS be attracted.

FEMA - Forex Trading

From the above RBI notification I understand that a resident Indian cannot trade forex in any other country. From the notification I am not able to understand what will be the legal implications if someone has remitted money to some foreign broker and trading for a while. I assume any contravention of fema is a civil offence rather than criminal one. Please help to understand the implications. I appreciate the help.

capital gain tax on selling of inherited property

sir,
after my father's death,me,my mother & brother are the legal heir of my father's house.we want to sell the ground floor of the property.municipality mutation is in our name i.e. me,mother & brother.
i am planning to buy a new flat in my name with the proceedings of the sale.but i will be required to use my mother's & brother's amount of share for purchasing the new flat.My question is how my brother & mother will give me their share of amount for purchasing of new flat?what is the procedure?
what will be the capital gain tax incase of my mother & brother?
