custody of children

mother has two children - 9 year old boy and 7 year old girl. she works and earns. father does not work. simply sits at home and ill-treats wife. misunderstanding results in father taking away the children to undisclosed destination. claims that children are for living with him. mother wants custody of children in their best interest. what can she do?

we had kept a case in sdjm court berhampur,orissa .in theyear2004..our lawyer there mr.nandakumartripathy is not telling facts.how can we find out the position of the case.case number is cc.29/2004.when we contacted other lawyers also in berhampur we are not getting any information.

court case outside india

hello all learned
my clint lady who married in gujarat with the person who is citizen of forein but at present lady belongs to india at the ,gujarat stat her husband lodged divorce case from leister court the notice served to the lady and date is also passed already for the lady now she wants to defence in the casse but question is that she is poor and no having means and she is unable to understand the language also now what steps should be taken for the defence from the india whetehr it is possible to defence the matter through conforence with the permission of the court with the help of mediator who know the english

Wrong Property Description on Stamp Paper, what to do now?

A document (deed) was registered in the office of Sub-Registrar, Delhi for immovable property. We've received the registered-original copy. But after receiving we found that property description written on e-Stamp Paper is wrong. However its just one letter. It shows B instead of D for block. My agent said he will get it corrected by getting a correction letter from the e-Stamp paper issuing agency. but its been now more than 2 weeks, hes just lingering on and this is making all of us crazy.

Could someone please suggest me what can we do now to make it correct after it has been registered in the office of Sub-Registrar, Delhi.

is there a time limit to file a suit for redemption to redeem the suit property.can it be filed even after 30 years as specified in Limitation Act?

writ before highcourt for direction to government

Respected all members
I want to file a petition before highcourt chandigarh for issuance of direction to Govt. to stop overloading in goods vehicle & for restraining tractor trolley which are being used for commercial activities like goods transporation on freight that which is violation of motor vehicle act,plz guide me regarding procedure and provision am i have to file a PIL or civil Writ petition. Thanks

harrasment by police

R/members
police is harrasing me for last one month on pretext of false theft case,without any notice or writing work police daily calls me & forcibly restraining me in police station for wholre day & late night allow me to go home with a direction to come next morning,even they are not showing me any complaint against me,my father has met with higher police but all proved futile exercise,now i want to file a application before session court seeking blanket bail or issuance a direction to police not to harass me & in case of arrest issue me notice,there is no any FIR against me till now,under which provision /section i can file this application before sessions judge is there any remedy before highcourt me than under which provision plz help me.Thanks

Company Law

1.Two public ltd companies were formed. 2.The date of certificate of incorporation are 24-01-2008 & 08-05-2008 respectively.
3.The certificate of commencement of business has not been taken till today.
4.Subscribers to MOA & AOA are 6 individuals and 1 is listed public ltd company (say A Ltd). A Ltd subscribed for 49,994 shares out of 50,000 shares and rest of the individuals subscribed for 1 share each.
5.Till today neither from A Ltd nor from 6 individuals, money on account of share capital is received by these companies.
6.Further, while finalizing the annual accounts of A ltd, the above companies were not shown/disclosed as subsidiaries and there accounts were also not incorporated in the annual report eventhough there were no transactions/activites done since commencement certificate is not obtained.

So following queries are raised-

1.Does A Ltd really becomes the holding company eventhough it has not purchased share capital of these companies.
2.Now A Ltd does not want to be the subscribers to MOA & AOA simply because they do not want these companies to be its subsidiaries. So now what is the remedy?
3.Although share capital is not received, can A Ltd transfer the shares in others name & get rid of the status of holding company (if at all it becomes holding company)
4.What is the consequences, for not showing these two companies as subsidiaries in the annual report of A Ltd as on 31-03-09.
5.What are the compliances to be made for these two companies from the date of incorporation with respect to accounts, audit, AGM, board meeting etc.
6.Today also, they have not received share capital so then what accounts to be finalized and how to take AGM and what needs to be put up in AGM.
7.Further no commencement certificate is obtained. Can it receive share capital now.
