sec 406

Many years ago my ex wife filed a false case against me and my parents undr secs 498A, 323, 506 373 and some more secs i dont remember now. The hon'ble judge didnot find any evidence and I was awarded the case in 2015. She also took one sided divorce from me which i came to know of many months later. She remarried and there also she has filed a case u/s 125 for maintenance and that marriage is also about to dissolve.

The problem is that this lady has filed a case against me u/s 406 for recovery of stridhan which this clever lady has already taken with her. I dont have any evidence of it but this dirty minded lady has already taken everything with her while she started living with her parents and now she is trying to use sec 406 to blackmail me for money. I am badly frustrated because this complaint case is running from 2011. I am getting harrassed for a very long time and for having done nothing. Can somebody advise me something?? I am under depression because of this case. This lady is harrassing me for a very long time.

Consumer court case

I filed a C.C.150/2015 in district forum against builder and appeared personally after two years as the case was not disposed of even after two years. Then the forum was kind enough to hear and dispose of quickly. The order was passed in may 2017 in favour of me with cost.
But the builder filed appeal in state commission . Again i APPEARED and requested for quick disposal showing the reasons as given below.
Before the Hon’ble Kerala State Consumer Disputes Redressal Commission, Trivandrum
FA/----/2017

Dr: C.R.Ramdas ---------------------------------------------------------Appellant
M.D, Cheloor Property Development Projects ltd, Thrissur.
(Through advocates A.Abdual Kharim and Narayan.R)

N.R.Chandran-----------------------------------------------------------Respondent
Flat No.15, 4th floor, Cheloor Krishna Karuna, West Nada, Guruvayur-680101.

It is most respectfully prayed that this Hone’ble commission may kindly expedite the above appeal hearing and disposal, to an earliest date due to the following reasons.
1. I have to go to Toronto , Canada at the earliest for a long period. The Hone’ble district forum, Thrissur expedited the disposal of this complaint considering my above request. The appellant is also aware about this and the grounds given in the appeal is baseless and causing further loss to me.
2. I had purchased air tickets for 2nd August and again for 6th October 2017, which had to be cancelled and suffered loss. The copies are attached herewith.
3. The LCR is already received by the Commission.
4. I have to settle the dues to Apartment Owners Association based on the order of CDRF, Thrissur , which is stayed now.
5. I also did not request for separate interest for refund amount in the C.C.150/2015 thinking that the consumer complaints would be settled quickly. This is also causing further loss for me.
6. I am Senior Citizen

Trivandrum,
N.R.Chandran

But the state commision did not accept my request and adjouned the case to May 2018.Is there any way to overcome this situation. Still govt advertises in TV saying that consumer case would be settled in 3 months. Is there any priority for senior citizen appearing personally.

Kindly give valuable suggestions

Thanks and regards,
Chandran

Hindu succession act

Respected Learned Counsel,
I would like to know that the if the deceased mother had prepared the will but it is not probate. In the will she had equally divided the property among 2 son and 2 daughters. But now the brother is creating an obstacle in giving the share in the property and that property is situated at Bandra. My query is that the position of the daughter in financial term is not so good to go for a civil filing.Because to bear the court fees itself is the difficult task for her.
Now the property is fully controlled by two brothers and out of two married daughters one daughter did an intercaste marriage and one daughter is struggling for share in the property. She has shown me a copy of the will also being an independent practicising advocate i had visited site and came to know that daughter is also entitiled to property as per the amendment made in the year 2005 under the hindu succession Act.

What other legal options available with her to get the shares in the property?

Complex scenario : caste certificate

Its a bit complex scenario and need your help.

My mother and father belong to same caste( Dhobi). Mother did her education from MP. Her parents ( my maternal parents) were also of the same caste but my nani ji belongs to UP( have valid caste certificate from UP)while we can assume my nana ji belongs to MP( i am not sure about his origins). My nana ji expired when my mother was a child. She was raised by her mother and than got married in UP in the same caste.
Post marriage Mother applied for caste certificate from UP and than worked few years with CEntral government and for last 24years with UP state government. now there is inquiry going on that she has made a false certificate as the caste of a person depends upon the father and since in MP caste comes under OBC she cant claim the benefit.
Hope i am able to explain the situation. there are only 6 months left in her retirement and would request the esteemed member that if they can show us the way ahead.
