Salary attachment of jdr

jdr is a government teacher, and his garnishee received the warrant in 2017. E.P. is allowed in 2019. when i filed the sent for petition in 2021, garnishee sent his reply to the court that the jdr is transferred to another school in the year 2022. through the court, new garnishee also received the salary attachment warrant in this january-2023 but he did not respond in anymanner. what are the steps to take. please suggest me. thank you to all.

Can car sale affidavit on rs.10 stamp protect the seller?

My father who died 3 years back had a car. My mother sold that car a few days back. The car's RC is still in my father's name .While selling the car, my mother and buyer signed the car sell affidavit on stamp paper with thumb impressions.
It was mentioned in the affidavit that from the date of purchase the buyer is responsible for the accident, etc.
Now the problem is that the buyer of the car is delaying the RC transfer.
Q1)I want to know that if someone has an accident or a criminal offense with that car, will I or my mother have any problem with it? Can my mother be convicted by law?
Q2)A few days back, the buyer of the car is telling us that he will get the car transferred to his son's name. If the car's RC is transferred in the name of another person who is different from the one who had signed the affidavit, can it lead to legal problems for my mother in future?

Tenets v/s landlords

We r tenets in pune we wants make society our old landlord is vanished another person saying I am landlord but last 15 years he hasn't collected rent from us he didn't send any notice any tenets we have doubts about in such situations can we make society

Legal heir

Hello,
I am writing this query on behalf of my sister, who's husband passed away recently. When we approached for Legal heir certificate, the Local body (Panchayat Office) told us that since the deceased mother is alive, as per Hindu succession act, along with the wife and children of the deceased the mother also will be a part of Legal heir. My question is if Mother passes away, will her other children (i.e. deceased brother/sister) will also turn to be Legal Heirs? Or after mother passes away, the wife and children of the deceased only continue to be Legal Heir.

Rcr decree vis a vis maintenance to wife

dear sirs

I am paying interim maintenance u/s 125 cr pc to my wife and minor daughter since October'2015 at the rate rs 4000/- to wife and rs 5500/- to minor daughter per month. I have got RCR decree and order in my favour in November'2019 where the additional district and session judge ordered my wife to join matrimonial home along with daughter immediately.
She didnot come though i wrote three letters to her to come back. I have updated the judicial magistrate court about the decree and order through petition and prayed for withdrawal of maintenance u/s 125 cr pc to wife and daughter as well since she is now 23 years old. But nothing is happening. My maintenance case is at the evidence stage for last 5/6 years. My wife is simply enjoying the maintenance for both herself and daughter. i could not my daughter for last 6 years. i am now 55 years old and my income is 15000/- per month. I am feeling helpless. what should i do ?
1. should i appeal to the district judge for removal of maintenance in the light of the RCR decree and order or pray for speedy disposal of my maintenance case u/s 125 crpc
2. should i go to the High Court for redressal of this matter

Gift to nri son

Dear Sir

My son after completing his studies has recently started working in USA and is taxed as per US laws. He needs money to purchase certain assets in USA for his needs. Can I as a father Gift him and remit USD 50,000 from my resident account in India as a normal foreign currency remittance. Will there be any tax implications for me or for him as per law. Also what is the limit that I can remit money as a Gift to him

Statement under crpc 161 recorded twice.

Respected legal freternity,
I am undergoing a false criminal case. I want to know if statement under 161 can be recorded twice or more.

Already 2 charge sheet has been filed. Statement under 164 has been recorded 4 years back. Now the opposite party has come up with fabricated documents and asked for the further investigation.

1.Can statement under 161 recorded multiple time?
2. If new statement is recorded then what will happen to first statement under 161?
3. If no such facts (whatever has been submitted in further investigation) were ever mentioned in statement under 164, then can it be used as omission and contradiction in cross examination?

Pls help me with these queries. I will be grateful to you all. Thanks

Using signed letter in section 145 of evidence act

Namaste to all,

I am roped in a criminal case. I am a Govt. Servant. My opposite party has sent complaint letters to PM, CM, governor and my office Administrator. Additionally they have also lodged online complaint in which they have sent the same letter along with FIR, and deposition in court. All papers are signed and it go on to describe the case in very different shade as it was in FIR, 161 and 164.

I want to know if I Can use these complaints to contradict the opponent under sec 145 of Indian Evidence Act.

Fingerprint

My query relates to a document registered in 1957

Following a proper application submitted by the husband, the sub registrar had then visited the home of applicant’s ailing wife to register a Power of attorney. After satisfactory verification ( registrar has a clear noting on document itself) and confirmation from witnesses the document was registered but there is no corresponding entry in fingerprint register maintained by SRO. Can someone now claim the registration as fraud due to missing fingerprint entry in register. Is there any time limitation applicable.
