Parking policy

In our society in Mumbai, the builder has sold both open and stilt parking spaces to flat buyers. However, after the formation of the society, parking spaces have not been reallotted, and the builder's purchased parking policy continues to be enforced. Society members are allowed to rent or sell their open spaces, and some members have purchased more than two parking slots, profiting from members with genuine parking needs. The society currently does not have any bylaws in place regarding parking. Recently, the society started charging one lakh rupees to members who require parking, even if the available space is in another wing that is not easily accessible by road. I have explained the Supreme Court judgment of 2010 and the Maharashtra Ownership of Flats Act (MOFA) rules regarding parking, but the office bearers argue that members have already paid a substantial amount to the builder, and therefore, the parking policy cannot be changed now. The builder has not mentioned the allotment of open spaces in the agreement; only the amount for stilt spaces is specified. The society is relying on a Rs10,000 receipt provided by the builder to flat buyers for open spaces parking. As a new member of the society, I urgently require parking and need guidance on how to handle this situation appropriately.

Article 226

In the absence of any substantial question of law, the court posted the case "for orders". The Appellant filed an amended petition under Order 6 Rule 17 of CPC for additional substantial questions of law and filed an additional evidence petition under Order 41 Rule 27 of CPC. Both these applications contain false statements (Section 209 of IPC). The court allowed those applications and admitted the 2nd appeal. The appellant caused extensive damage to property & personal injury that attracts Articles 14,19, 21& 300A.

Question: Rather than asking the same court (where 2nd appeal is pending) to consider the issue under 340(1) CrPC and then refer to the Magistrate for action, a petition under 226 be filed for necessary orders under Section 209 of IPC to expedite the matter.
Many thanks for your help.

Land reclamation

Hello,
I Belong to a small town from UP.
Recently my father retired from the Post Of Superintendent Engineer at ONGC and with his retirement fund he purchased some agricultural land. The problem with the ground is that it is not at all plain somewhere there is a stack of soil somewhere not i.e. it is not evenly scattered. The land is higher than the back and low from the front due to which the water doesn't stay in the ground and it erodes the soil with it due to the gradient/slope. So my father decides to make that land plain i.e. to make the soil evenly scattered with the help of one contractor. They started digging the higher portion with JCB and keep on shifting that soil with the help of a dumper to my uncle's farm which is in front of our land and is very much lower than the road in order to have mutual benefit and make the ground more appropriate and good for cultivation for both of us.
After 2-3 days 2 police officers came and started asking why you are doing this with the contractor, the contractor is already known to the police officer and gave some money to them which they say was "kharcha pani".
After four days DM of the District changed and all the land mining workers stopped their work some police officers came and ask to stop the work.
Recently North India faced unfavorable weather due to western disturbances. So my father and uncle went to have a look at the land as our land was still irregular and was still on a high slope gradient so the water cut the soil and erodes it to the road and my uncle's land got filled with standing water due to rain.
it's been more than a month. We couldn't find any way to resolve this situation. I couldn't find any way out. Land mining is illegal but I just want to know make your land appropriate for cultivation is also illegal.
I am not getting where I should put up my query in the DM office, SDM office, SP office, DSP office, Block Development Office, Nagar Panchayat office, and Tehsildar office.
We are looking to settle this issue and make our land appropriate for cultivation before the rainy season as rainwater will make the land good and after that, we can sow the Rabi crop this season.

Rash driving and compromises

I would like to seek your guidance regarding an incident involving a complaint I filed at the police station. I reported an instance of rash driving by an individual. Subsequently, the police officer contacted the person in question, and unexpectedly, they offered me Rs. 1000 as compensation for damages, which I had not requested. Additionally, the police officer compelled me to write a statement on a paper stating that both parties had reached a compromise, and I had accepted the compensation for my damages.

I want to know whether the paper I wrote and signed at the police station is legal or not and I am barred to register an FIR for that matter.
