Consultation regarding pending 498 case

The case is as below
My sister in law has filled false 498a case against me and my family members in sept 14 against which we had filled quash application in high court in Dec 14 where we were able to get removed three persons name from 498 a which include my wife and two uncles but there are still 5 people names remained in court which includes me ,my elder brother who's wife filed the complaint, another younger brother and my parents father and mother.now the case in trail Court and date is in Feb month so I want to get the name discharged my name from the case.
1.Can I file the discharge application in trail Court before Feb month and is it possible that arguments can be started in the month of Feb on the date itself.
2.How much time it takes to get name discharged from the 498 a case
3.How does the discharge application process works.
4.when the 498 filed we have approached high court the Court advised to district court to do bail so do we required to take regular bail now again from trial court
5.I don't want to attend the Court dates so do I apply for permanent dispense from the Court dates.
6.I have my L1 visa interview in coming days so can I go attend the interview without disclosing the pending 498 a case against me or I have to wait till the name get discharged from the case.
7.Is there any problem in immigration if I will not disclose the pending case from my side

Metarnity leave and metarnity benefits during probation period in central govt. service.

My wife just joined in a central govt service on last 06/11/2015 as her EDD is 05/02/2016 she applied for metarnity leave from 20/12/2015 to next 180 days as per Central Govt. rules. But her employer told her she had to serve continiously 80 days to avail this metarnity leave with total benefit other wise the less duty days will be counted as without pay and the probation period also extended with due course. Now I like to know is there any rule is exist in central Govt.to avail metarnity leave? I will be highly obliged if any one provide me the exact rule as circuler/memorandum etc. published by Govt. of India regarding this perticular case.

Rcr & child custody

Dear Sir,
At present my sons age I 8.9 years. Case of Child custody in running in the court. My wife is denying visitation to my son and not complying court orders. My Son is comfortable with me. I also I filed RCR log back. Now for the last 1.5 years she is not attending court dates. Even she denied visitation. 4 months back I got RCR & Child Custody Ex-parte common decree in my favor. My wife is directed to resume co-habitation along with my child. Even my lawyer sent letter to her to come back with son and join matrimonial home. My questions are:
1) If my wife doesn’t comply order, I can go for divorce after 1 year from date of RCR decree. Can I file divorce now ???
2) My visitation is denied. What about my son. I have not seen my son for last 2 years. Now my child is hammered by my wife. How to get access to my child legally ???
3) How to implement RCR decree ???
4) How to implement Child Custody.

Benami transactions (prohibition) act, 1988

Dear Experts,

A transaction took place prior to the enforcement of Benami Transactions (Prohibition) Act, 1988 and suit was filed after came into force of Benami Transactions (Prohibition) Act, 1988 – Whether the suit is barred by the provisions of the of Benami Transactions (Prohibition) Act, 1988?

Taxable defective return a.y.-2013-14 u/s 139(9) and how to get refund

One of my client had been online submitted I. T. Return A.Y.-2013-14 in ITR-4 on Dtd. 14.09.2013 in wrong jurisdiction.The return is fully defected. My client is a mechanic of maruti. He working as a contractor and a number of mechanic working under his supervision. He receives money in u/s 194C and TDS deposited according to. Now the above said In A.Y.-2013-14 a it return is deposited on dtd. 14.09.2013, All the figure in the return ie. s/debtors, s/creditors, cash in hand , Net profit etc. is wrong mentioned.The Return shows that there was a 16920/- tax and no self assessment tax paid against it. A notice u/s 139(9) of IT Act 1961 received on dtd. 13/12/2013 in annexure-A from the local income tax office. The client not replied against it., Thereafter ITR-V send afrer sign and received by cpc Bangaluru after due time. There was no notice no. mentioned in the notice.After telephonic conversation from CPC it is known that the Return will not process as it is received after due time.Now if I put all the correct figure in I.T. return then there will be refund in A.Y.-2013-14. I want to get refund after putting all the correct figure in the I.T, Return in A.Y.-2013-14. Now what to do for filling correct return and to get refund. Please anybody help me in this matter.

Can the beneficiary's father witness the will

Hi all,

My grand mother has willed me a property and its been witnessed by my father .Is the Will valid considering my father has witnessed the will.Also note that there are other beneficaries also and the will has been registered .

Rights of joint holder of a property upon death of another

Hello all,

I am having a property which is jointly held by me and my brother. We had bought that from BDA, Bangalore in an auction. Now my brother has died and he was unmarried when he died.

Since the property was jointly held by both of us, his share of property will have to go to my mother since he was unmarried. That is my understanding. Is my understanding right.

To get the khata transfer done I need to apply for a khata tranfer again in both of our names, my name and my mother's name.

Is there anything else that I need to do. We had not obtained the title deed of the property. I guess that needs to be done after khata transfer is done. Kindly let me know if my understanding is correct as per law. If I have missed anything kindly correct the same.

Sir,
My Father have made a will in 2007 regarding the transfer of shop in my name, he was expired in 2010... do without doctor certificate does will stands valid as that will is being Notoraised and attested by 2 witness.
