Legal Doubt

A owes me 2.5 Lakhs. I take his signature on a blank pronote, 2 green sheets & a Re.20 NJ Stamp Paper.

He sends me a lawyer notice hat the Blank Security invokes IPC u/s 467,468 (forgery) Copies to Police is marked.

How shoul I defend this & recover my money?

Reliving Letter Issue ( Reliving date is equal to joining date in new org.)

Dear sir,
I was working for an IT organization for last 3.4 years after that i joined a new organization at the time of joining in new organization i was not having Reliving letter so i told my new organization that i will provide it after 1 month, and after 1 month i gave them reliving letter.

Now the issue is Relieving Letter is of same date as i joined new organization. And 2 days back I got a mail from my current organization asking about the explanation of this, as they are saying that one person cann't be present at two places at the same date so now they are asking for explanation and relevent documents otherwise they are going to stop my salary of this month.

My explanation is : My resignation got confirmed on 20th dec and it was sunday on 21st dec that's why i got reliving letter of 22nd dec and i joined on 22nd dec in current organization.

Now PLEASE tell me what should i do?
should i request for another reliving letter of 20th dec?
or what else document can support my explanation?

PLEASE HELP ME ASAP..I am in really big trouble.

Thanx for replying so quickly.

Actually i have given "My explanation" in reply of that mail which i recieved from HR,

Here are the lines of my Relieving Letter
"With reference to your notice of resignation submitted to Company, we accept ur resignation and relieve you of your duties from 22nd Dec, 2008".

Now my question is:
#1. If i take fresh Relieving letter from prev org then will there be any problem for prev org as they are issuing two relieving letter for one employee Or can my current org can create any problem to my prev org?
#2. And do i need any supporting document with fresh Relieving Letter to prove the reason and it's validity?

Plz make me clear on all above mention points, i will be very thankfull to u.

Legality of Employment clause

Dear sirs,

I am working as a software engineer in one of the MNC.
Following is the termination clause given in my appointment letter:

"Your employment with the company may be terminated by yourself or by the Company by giving in writing a minimum of forty five days notice or salary in lieu thereof. Notwithstanding, the above the company reserves the right to pay the equivalent of the prior notice period in lieu of notice and it is acknowledged and agreed in advance that this amount will be adequate compensation to you for the early termination of your employment. Further the company may accept or deny the receipt of salary from you in lieu of notice period depending on the criticality of the assignment/work etc., as deemed fit"

Does this not violate equal justice paradigm?
An employer can terminate employment by giving salary but has RIGHT to accept/deny the same when an employee wants to leave early?
What should I do if I want to buy out my notice period and the employer refuses?

Nomination in Property

Dear Experts,

My father had purchased a property in mumbai suburbs through Mr. X for mfg activity in the year 1963. Mr. X was working with M/s. ABC as Property Caretaker. Due to lure of money & muscle power Mr. X sold plots of the land owned by M/s. ABC.
On Survey the revenue authorities put my father’s name alongwith Mr. X’s name in their records in other rights column as “tresspassers” and also declared that NA use is unauthorised.

The settlement could not be cleared and hence finally M/s ABC told revenue authorities to collect the NA tax from the encroachers.This was regularly paid by my father.

The latest property card shows my fathers name as imla malak which is shown in the revenue records in category “Other Encumbrances “ in the Property / Ruled (having tenure C-1)
Please advise on

1. What is the meaning of C-1 tenure
1A. What is our owneship title in above tenure and how do i Clear the title rights
2. Procedure to adopt change in name of the revenue records wrongly spelled by them
3. What procedure is to be adopted getting nominated for the title rights held by father to his legal heirs
4. Validity of a Power of Attorney (duly notarized) on behalf of the other successors which has been given to the deceased’s wife & son.

securitisation act

i purchased a house on auction under the
SRFAESI ACT.in the registered document conveying the property to me it is stated by the authorised officer that there is no charge or attachment on the
property.after conveyance in the backdocuments given by the bank there is an EC which shows court attachment before the date fo conveyance but after em by bank and it is not vacated.what is my remedy.can i sue the bank for cheating.

Employer Not Releiving

Dear sirs,

My name is Vineet and I am employed with a leading telecom MNC. I am a rehire here and joined it 10 months back.

I had myself applied for this job, considering the nice time and learning opportunity I had in its previous centre, and based upon my earlier performance, was offered.

But here I found situation to be much different and work culture diminished.Long hours, Back pain and red eyes became a regular problem.
Now I have got a job with another good firm and they want me to join as soon as possible.

1) I have 45 days notice period here and it is mentioned that I can pay salary in lieu of that if I do not wish to serve full notice period.

2) I gave them a 15 day notice period and sent my resignation through e-mail. But now my manager did not respond to this e-mail.

3) HR Manager and my manager both asked me to serve the full notice period. When I talked about buyout, they said "such a option does not exist", while it does exist as per my appointment letter.

4) They proposed to change me to a new project which is "supposed" to have a more work-life balance based working condition. But as I know that this project will also be managed by my current manager, who is, the only one responsible for spoiling culture of this company, I do not want to consider that.

Now as I have made up my mind to change company, ready to buy out notice period, does this company:

1) has legal rights to retain my experience letter?
2) has rights to not do my Full and Final settlement?
3) What legal action can I take against this company in case they do not give me my relieving cum experience letter and my dues?

The reason for not releasing me is said to be that they can not find a replacement of me and they do not have a mitigation plan.
But as this company has been unethical to by all means in my stay here, I do not wish to forfeit this good offer. Can they force me to stay legally on basis of such statements?

Please provide me you exper help. I am in urgent need of this.
