CRPC U/S 391 READ WITH 401

OUR LAWYER DID NOT EXHIBITED IMPORTANT DOCUMENTS IN THE TRAIL COURT THOUGH FILED DURING THE COURSE OF VARIOUS HEARINGS AND ALSO THE SESSION COURT DID NOT CONSIDER.NOW WE HAVE MOVED TO HIGHCOURT THRU IA AFTER FILING CRIMINAL REVISION U/S 391 READ WITH 401 TO ENTERTAIN THE DOCUMENTS ALREADY ON RECOERD.
CAN YOU ALL EXPERTS SUGGEST SOME DECISIONS OF SC OR MPHC ENABLING TO QUOTE.TKS

Retainership based hiring

Dear expert,

Most of the corporates these days hire manpower on retainership basis for a year - 3 years on professional fee. The fee normally is revised based on the basis of performance or as agreed upon at the time of engaging the concerned person as a retainer. My question is -
a) Are there any laws in India that states what % or number in an Organization can be hired as a retainer.
b) What are the precautionary steps an employer should take with regard to this??

Mishandling of Account - ICICI

Dear All,

I have an account with ICICI and my card was used fradulently; have blocked the account immediately on noticing the same and made written complaint with FIR in local police station.

This happend in Jan 09 but ICICI not responding to my claim.

Surprisingly, received some more debits in Mar 09 through some card number which was never received by me.

Need your guidance on the action that could be initiated to fix this matter and to make ICICI to pay compensation.

PoA for consideration subsist after the death ?

Respected lawyers,

If a land owner executes a registered PoA in favour of another person giving rights to sell the landed property for a consideration, and the another person sells to third party for the same or more consideration, I just wanted to know whether such PoA remains subsisted and valid if before or after the sell to third party an original land owner dies. The PoA is for consideration, i.e. the original owner has recieved consideration for execution of such PoA from the another person.

We have put complaint against Cheque Bouncing of Rs. 45 Lakhs unfortunately the Order came against us in Magestrate Court. We went to High Court where our case was not Admitted. Whether we can file again in High Court to another bench or we have to go to Supreme Court. If Supreme Court then can you suggest who will be best Law Firm to fight our case.

Taxes payable by Cooperative housing society

Ours is a cooperative housing society located in Pune (Maharashtra) having annual collection from members Rs 11 lakhs apart from interest income Rs 2 lakh and other income Rs 1.3 lakhs. Society has employed 17 persons and annual payment towards salary and perks is about Rs. 7 lakhs. Please guide whether society has to
a. Pay income tax towards interest income and other income?
b. Deduct professional tax from the payment made to employees?
c. deduct TDS from payment made to suppliers/ service providers and professional fees?

Is there any exemption available to cooperative housing societies in any of these taxes

NON RECEIPT OF OFFER LETTER

According to Regulation 22(3) of the SEBI (Substantial Acquisition of Shares and Takeovers) Regulations (“SEBI (SAST) Regulations”), the Acquirer is required to send the Letter of Offer to all the shareholders of the target company (shareholders as on the specified date)

pl. guide me :

1.the Acquirer is required to send the Letter of Offer by ORDINARY POST OR UNDER U.C.P OR BY REGD.POST.

2.In Regulation 22(3) of the SEBI (Substantial Acquisition of Shares and Takeovers) Regulations (“SEBI (SAST) Regulations”),NOTHING IS STATED ABOUT MODE OF DESPATCH.And if it not stated, whether any ruling or judgment is available or is there any PROVISION IN OTHER ACT CLARIFYING THE SAME.

Since I lost huge monetary gain due to the paper send by under U.C.P. & OFFER LETTER NOT RECEIVED BY ME WITHIN DUE DATE.

I need help urgently.
