Transfer of proprietorship concern on death of proprietor

Hello can you please let me know what are the legal formalities for transfer of proprietorship concern in case of death of proprietor. My father was the sole proprietor after his death the proprietorship concern has to be run by my mother. Does she have to change the pan card of the concern and where ever it was given on behalf of proprietor.

Crpc 125 for seeking maitenance

Sir/madam, my wife filled a maintenance case against me on 2014, and the case is still pending in family court. both party's evidence is closed but argument stage is not start yet. at this moment can i file sec91 for seeking of her bank statement?

Letter of administration

queries:

1. "A" a died inteste leaving behind wife and one minor son, now society is asking for Letter of Administration for transfer of Share Certificate. Now widow is applying for Letter of Administration.
How can she get consent Affidavit from the minor Son ? What is the procedure to overcome such situation?

2. There are Bank accounts also...... It is necessary to mention colosing balance of each Bank in the Schedule.

3. IMP ...... Need Order of Tax Master where in held that value of Share Certificate can be consider for Court Fee instead of Value of the Flats. Pls do needful............

False case

I made a small construction to the existing building without obtaining plan permission but in registered plot of mine. Some people of welfare society took stay order and brought d construction to stand still. I have applied for plan approval ... In case I get permission to construct can I vacant the stay?. Welfare society is expecting some money...wat do I do?

Writ appeal

Dear Sirs,
My Writ Appeal filed in Madras High Court had come up for hearing on 10th February 2017 and the internet shows that the case was Disposed.
Till date the judgement has not come up on the net.
What is the probable cause of the problem?
Generally how long will it take to pass judgement.

Appeal when i am not a party to judgement or decree

Hi, I was not a party to Specific Performance between Plaintiff and Defendant. I filed an application for impleading me as an Defendant no 2 in the suit. But the court rejected the impleading application, because under specific performance it can not implead who is not part of the agreement. In the meantime the court passed the Judgement against the Plaintiff. Now I want to know if I can appeal in the High Court against the Judgement of the lower court and if yes, can you please provide any judgement for the same. Also if I need to pay the Court fee for the appeal. Thanks, Mallesh

Cheque bounce due to closed account

in the 2011 i issued cheque to third party without mentioning date but i filled the amount.in 2014 i closed the account.
till now the third party did not depoit the cheque in bank for collecting the amount. in any manner the third party can file a criminal case on me.the third party is running finance company,,,,i alreay paid the amount in cash,,but i forget
to collect the cheque.....he is black mailing with the cheque,,,,

Capital gain

On March 2015 my father gifted me his three self earned property wherein the 2nd property was mortgage in chit fund (loan taken by a joint account My brother and father) for 95 lakhs. In June 2017 the mortgage property came to auction by court order . We requested d chit fund and took some time and mean while I applied for loan and got sanctioned for 38 lakhs . Since there was a shortage I and my dad decided to sell the 3rd property(gifted property) and pay off the loan. We sold it for 63 lakh . We paid 1% as TDS and 2% for agent to sold it. We made one time settlement with chit fund and paid 57.50 lakh and cleared the loan. And also I closed my loan of 38 lakh. Nothing left in hand. Now my question is do I need to pay capital gain?
