Transfer of proprietorship concern on death of proprietor

(Querist) 09 December 2017 This query is : Resolved
Hello can you please let me know what are the legal formalities for transfer of proprietorship concern in case of death of proprietor. My father was the sole proprietor after his death the proprietorship concern has to be run by my mother. Does she have to change the pan card of the concern and where ever it was given on behalf of proprietor.

First obtain the Legal Heir Certificate of your Father.

If you all wish that your mother should be the sole Proprietor the other legal heirs should give NOC

Does she have to obtain all the mentioned documents even she had power of attorney at the time my father was alive. Also can she continue the business with the power of attorney without altering the proprietor name?
Guest (Expert) 14 December 2017
Power of attorney would be legally invalid once any one related to it demises .
