Property attachment in case of 125 crc recovery

Hi
My friend is facing 125 crpc recovery proceedings. His father gave him money and bought a property in his name. During 125 crpc he has given it back to his father and mother by settlement deed because he could not return their money. My friend lost job 4 years back still court ordered maintenance to his working wife who is earning . Now he is not able to pay and ready to go to jail. But will his settlement deed be enough to safeguard parents house. Will there be other litigation on the house by opposite party. How can he safeguard the house? Should her parents gift this house to his sisters, will that work? What can be done now to avoid any further litigations. He want to avoid any property litigations.
Or selling this house be ok?

Recovery under 101

We have received the recovery cetificate under 101 and now the defaulter is ready for 50% payment and go fo appeal and bring a stay order against the recovery
Is it possible ?

Bond related

I join the autonomous institute who come under University grant commission(UGC) central govt institution at the time of joining they demand to sign an stump paper for 5 lack bond when left the institute within 3year.Now i want to left institute than what i do. The institute can’t give me any training related to my services.and I qualified by written examination

Plz tell me process what i do.

Order placed-neither supplied nor payment return back.

Dear Experts,

I placed an order for supply of an "Item" from a foreign based Company" 18 months back. The company is also doing business in india. The owner of the company is staying in India. On several reasons the company neither supplied the "item" nor return back my money. Mail correspondence is there. The owner of the company agreed to return back my money, but failed to do so. The cost of the Item is rupees three lakhs ( INR) Shall I book a 420 case against him or not. So plz. suggest me, what I have to do.

Purchase of a new property with the proceedings of sale hous

I am 67 years old.I have sold an old house in my name for 27 laks. I intend to purchase a new house for 50 lacs jointly with a relative who is bearing the remaining amount through house loan. Can I be a second party of the registration. Will there be any property gains implications on me. kindly clarify

Service bond

Respected experts,
I am MBBS doctor. I joined a government organisation with a service bond. But i had to leave the job because it was a kind of typist job,while I was expecting to be in house Doctor . Now the company is demanding me the bond money which includes "liquidated damages" which includes SALARY PAID and TRAINING COST.
My doubt is 1- I had to break the contract because employer hid the working conditions
2- Liquidated damage should be REASONABLE. Salary paid was in lieu of my services. Can it be asked back ? I was in Mumbai,obviously it is the costliest city and I spent on my survival.
Can I avoid such UNREASONABLE TERMS in court ??

Hello..
What if police did not register FIR under proper section..?
Should I go for Protest petition…!!
Any judgment on this point that FIR must be registered under proper sections..

Crpc 311 in appeal.

The provision of CRPC is for any court and any procedding but Session court has rejected the application that it is not applicable for appeals.

Dear Experts,

Please let me know whether the Hon'ble Court(High Court) in WPC related to service matter can reject the Recruitment Rule relied upon by department/managment respondent and petitioner both? If so under what povision of law? It would be helpful if please provide case law.

Cancellation of lease deed

My father owns a piece of land in the Industrial area, Dewas. Recently we received a notice for the cancellation of the lease deed because the factory is not in working condition. Since I don't know much about this, I want to know what rights do my father lose upon cancellation of the lease deed. He was planning to sell the land anyway, will he still be allowed to sell the land even after its lease got canceled.
