Buying resale flat in cooperative housing society in west be

(Querist) 29 May 2018 This query is : Resolved 
I am joint owner with my father of a flat in a cooperative housing society of west bengal housing development board housing complex. The flat is small and We wish to buy another in the same premises. Is it possible to buy it in my name? Other wise if it is bought in my wife's name I shall not be eligible for home loan. What is the alternative. Can I give power of attorney to my mother for the existing flat.

You can't own two housing society flats in a cooperating Housing Society. The 3rd option seems to be better alternative. You can give a POA to your Mother for existing flat. Then you can buy an0ther flat in your name.

Cooperative society and Housing Board flat are two different types of property which are governed by different laws. Be clear where do you stand.
Relinquish/Sell/Gift your share of the flat in favour of your father and buy another flat in your name.

The secretary of your own society can help you to sort out your problem, if yours is a real necessity. Why don't you take help of your own society members?
