Can college reject to give admission to 2nd year

(Querist) 13 August 2016 This query is : Resolved
Hi,

One of my friend raised his voice against ragging, in return the college authorities blackmailed him. But he did not took back his complaint and gave a complaint to UGC anti-ragging cell, after which college authorities added many fake allegations upon him, and even unlawfully detained him, and he was rescued by parents with help of police, also parent admitted him to the hospital in a critical condition. Thereafter college authorities harassed him and his family many time. But he did not took back his complaint.

Now the college authorities has rejected to give him admission to SYLLB.

Can college reject to give admission on the basis that he has given complaint of ragging.

What are the remedies available.
Is there any remedy to him as an in-house student.
Is there any case laws related to such matters

The college cannot refuse to give admission on the allegation of raising voice against ragging, if so, file a writ of mandamus.
Sudhir Kumar, Advocate (Expert) 14 August 2016
they may be having other reasons. authorities of law college cannot be so fool to deny admission on this ground itself.
Adv. Mitesh Varshney (Querist) 14 August 2016
College has served notice to the student saying, that "he has given complaint against ragging and also that student has without proof stated that college staff has tried to build pressure upon the student to take back the ragging complaint.

Also since he approached the UGC anti-ragging cell and police for the ragging complaint, he has defamed the college, college staff and students of this college.

And so college needs explanation why not to file defamation case upon the student".

Student has talked for the admission, the college authorities have told to prepare for defamation case and they will not grant admission at any cost.

This is also to be noted, that the students who ragged this student have been awarded with best legal aid team of academic year 2015-2016.

And the list of people participated for various mega events, such as moot court competition, contains only the ragger students, and not any other students, I.e. Only 50 students are getting chance from 900 students for all events.

Even for various field visit such as jail, police station, president house, etc. Only those 50 students are getting chance.

Do not budge as it is a racket and must be stopped at any cost.
Immediately file writ petiiton in high court against inaction on admission as well as on the complaint done by the student.

Approach High Court with writ.

Lodge police complaint for illegal detention against the Management.

Mr. Mitesh,

What will you or your friend will do with the case law, as you desired?

Does not your description pertain to academic query, as case laws are desired only by law students to solve their academic exercises?

You can benefit from the advise of experts.

You have posted extract of notice served by college.

Sudhir Kumar, Advocate (Expert) 15 August 2016
what was the allegation.
Raj Kumar Makkad (Expert) 20 August 2016
The grounds for the denial of the admission are totally illegal and further denial of right to protection which is a fundamental right of a citizen. High Court shall take immediate action against such offender. it shall be better also to involve university as one of the respondents.
Adv. Mitesh Varshney (Querist) 20 August 2016
Victim has already given a written complaint to the university, but they have replied, its a matter between the victim and the college and university cannot do anything.
