Can i appeal now ??

Querist : Anonymous (Querist) 20 November 2011 This query is : Resolved 
10 days back,I appeared in Delhi High Court as a proposed buyer for a particular property.Even after giving the highest bid the deal was not given to me.It was decided by the Judge that deal was going to be given to the other Bidder.

2 days back,there was another date.I did not appear at that date as I could not figure out what to do till that point of time.

Now I feel that injustice was done to me because I was the best/highest buyer for that property.

I wanna file an appeal, can I do that?

How much time I have for filing the appeal?

Will the appeal be filed in the same Court or some other Court?

What more precautions to be taken??

if you were the highest bidder on what basis did the court pass an order that property under auction be sold to the other bidder.

unless we have the reasons recorded by the ocurt we would not be in posision to help you .

if order has been passed by single judge appeal would lie before the division bench of the high court

the facts stated by you are still incomplete...more can be explored from the orders passed by the Hon'ble Bench.

if you were provided with an opportunity to give highest bid then you should have been present before the Hon'ble court, may be through your counsel.

inaction on your part can not be fault on the part of the court.

well, consult your lawyer and find out any legal loophole and proceed for the next step as per rules....

Yes. Your stated particulars incomplete. If you are the highest purchaser mean how court can deny your rights? And also before high court parties appearance not must. Counsel's appear enough. But your case?

And according to your statement am assuming that your case might be a writ petition. So 30 days limitation for prefer appeal against writ petition's order.

As per facts mentioned by you, it seems that default in your part. It is suggested to discuss issue with your lawyer then move ahead.
