Can we take the amount refund as per state consumer comission and file and appeal for enhancement ?

(Querist) 13 September 2012 This query is : Resolved
I have received an Order from Delhi state consumer commission in my favour against the builder to refund money alongwith interest of 9% only.

I have been paying interest @14% which has been overlooked by the forum.

I would request you to guide me on what action can i take ?, also i am facing a lot of difficulty in paying the EMIs and rent as builder has not refunded a penny.

Can I take the money and file an appeal ? Is there any recource to people like me ?

to the bank from whom loan is taken, i had filed all home loan statement as evidence... however bank is not a party. its just a case against the builder

you can go in appeal aginst the orderto national commission . since you are paying 14%interest to the bank and you have produced bank statement it ought to have been conisdered by state commission while passing order .

Dear Sir,

The issue is Appeals in National commission are taking 5+ years to complete, in the meantime shelling out EMI n rent is getting difficult.

Is there anyway that I can file the appeal for enhancement and also collect atleast the money as per order so that I can close my loan and stop emis.

Thank you all for your suggestions. I really am obliged and appreciate the experts.
