Card settlement at Lok Adalat

Dear Experts

I did settlement for my HSBC credit card at Lok Adalat to be paid in 6 Emi.Now, being jobless for 4 months in a row. I'm unable to pay the agreed Emi.HSBC men come to my place time and again and threaten.I've made it very clear to them, why I'm unable to pay.They threaten of court order and talk harshly to my mom.

I don't know what could be the likely consequences.

What can I do? Please help and guide.

Lok Adalat order is just quasi-judicial order will be always Challengable. you give complaint against the bank officials in the police station for harassment.since you have surrendered your card, you will not have further penalty, requisite can be made to the bank officials.

1-The Bank can not harras the party/ and his relatives . complaint can be given

2 A Lok Adalth Settlement/proceeding is Civil Decree, to be executed as per Order 21 of CPC

3 If the party/JDR is unable ot pay the settled installments under the Decree , Lok Adalath settlement /Decree can be executed in civil court , as per the procedure prescribed under CPC

I agree with Vishweshwar Rao. The decree of lok adalat is executable as a civil court decree under the provisions of order 21 of cpc. Bank can only file its execution and rest depends on the court.
