i made an agreement with a buyer for my 3 bhk in 2008
but still he has not started constructing the flat.
As the time has elapsed to file a case in consumer court.
How can i file a case in high court directly and also should i surrender the documents or directly file a case?

though ur case is time barred but send legal notice to him and if u get any type of acknowledgement from him then u can also file case in court.

Terms of agreement need to be referred. Consult local lawyer.

you are not consumer. it seems that in consumer form, the case would not maintain.
file civil suit for specific performance or cancellation of agreement.
consult local advocate for above purpose along with agreement.
