Change of Ownership

(Querist) 16 July 2011 This query is : Resolved
My grandfather died intestate leaving behind
Wife and Daughter which is the best way to change the ownership of the house to the daughter?
KAMARAJ BHARATHY G (Expert) 16 July 2011
Dear Madam,
In the intestate property, Wife and Daughter of deceased person have equal right. Hence, the wife has to execute release deed in favour of her daughter for releasing her right in the intestate property.

Yes. I agree with the views of Mr. Kamaraj. The relinquishment Deed executed by your mother has to be registered.

Thank you for the quick reply, the Relinquishment deed from my Grandmother to my mother is the solution you provided. Is it that we need to pay 1/2 of the 1% stamp duty levied on this deed?
R.Ramachandran (Expert) 16 July 2011
For the rate of stamp duty, it will be adviseable for you to check up with the Sub-Registrar's office concerned.
Lavanya (Querist) 17 July 2011
