Cheque bounce - 138 warrant

Guest (Querist) 23 July 2018 This query is : Open
Hi Experts,
I have inverted my money in a chit company. I have paid my regular due's through online transition to their company account. the chit company they dragged me long time without paying back. After the lot of struggle I have got a cheque (in post dated) in their company name. On the date of presenting the cheque I came to know that there was no transition in that account for the last 4 months. through an lawyer, I have sent a legal notice to the company through the register post. waiting for response for more than ten days. Now I came to know their registered company & all the branches were closed by for the past 20 days. Is there any chance of getting my money back through 138 warrant.

If cheque is bounce you can sent notice for cheque and on non payment within 15 days you can file complaint before court and after decision you can recover the money.

Thanks you very much for your reply Sir.
Here I have sent the legal notice to pay the money back with in 15 days. but In this case the Chit company is closed and couldn't find owner of the company. Can say he is abscond. So anyway my legal notice going to bounce and come back.

The cheque date is 5/07/2018, i have presented and got bounced on 6/07/2018. I have sent legal notice on 14/07/2018 through a lawyer. now lawyer is not responding me properly..its been 14 days i'm waiting for the acknowledgment for my legal notice.
Is that mean the cheque will expire with in 7 days(on 04/07/2018)? When shall i register my complaint in court?
