I just joined a small Tech support company 3 month back, My owner are not professeional and more like harassing the emplaoyee to get the worked done. He learned from his sources that i am going to quit after collecting my salary. He is holding back my salary and the travelling allowance that he already issue me a cheque. he asked his bank not to clear the cheque. So i am trying to find out the easy way out. i know about the labour court, but in labour court, you have to bribe the labour inspector to get your salary cleared, or he himself tell the employer that you can hold back the amount till he find some easy way to get his commision.

It appears that the cheque has been issued in lieu of salary due to you. Certainly, you can proceed under Section 138 NI Act.

Discuss with local lawyer, send notice u/s 138 NI Act for dishonor of cheque and later file suit for the same.
