My client is facing problem. She was married in 2002 give birth to a child in 2003 and got separated in 2005.
Now she wants to apply passport for his son who is now 6 year old. She doesn’t want to put his father name on his passport.
One of his good friend wants to become guardian of his son and already taking care of all his expenses. He is a married man having two children.
Now my client wants to put her name in mother column and her friend name in legal guardian Column.
Is it possible?

Legally, when the mother is alive, she is the natural guardian. Your client's friend name cannot be used as a legal guardian name in the application.
There is no harm or sin in putting the father's name in the child's passport application. This is a simple issue. Your client's hesitation in not putting hte father's name is unnecessary and wrong in this regard. Please advice your client accordingly.

I fully endorse the above view. It is not understood as to what harm in using his father's name in the passport rather than using the name of a stranger ?

no. cannot use friend's name. Let her give certified copy of the divorce papers and put in her name. She is the mother as well as natural guardian. That will suffice.

Can it possible that she use only her name and left both column or She can put her name as mother and as legal guardian.
