Club denying membership

(Querist) 07 February 2012 This query is : Resolved
We have office on ownership basis in one business corporate park. It also has a club. Some of our directors applied for membership and also paid fees by cheque.

The club after 15 days or so returned the cheque and issued letter denying membership without giving any reason whatsoever.

What action can be taken against club?
Devajyoti Barman (Expert) 07 February 2012
Every Club has its its own Rules and Regulations.

The denial of membership to someone would not give rise to any cause of action.
So sooner you forget this issue, it would be better for you.
V R SHROFF (Expert) 07 February 2012
It is a Pvt Club, and to accept you as member on not is at sole desecration of club.

No legal injury, no remedy to you.

If a pvt car do not give you a LIFT, what action can you take against it.

This is same situation, even if u want to share petrol cost.

Since you have not described anything about the contests of the the Constitution of the club. I agree wuith Mr Shroff and Burman. It is only the Govt bodies which are supposed to record reasons for their decisions.

In case it is mandatory as per the registered constitution of the club, to allow memebership to all Directors fo teh companies i the vicinity, then you can can consider taking action.

What action can be taken against club?
Answer: No action can be taken legally, if club is private.
However, you can check bye-laws/rules and regulations of club,to know reason for non-accepting as member.

It depends upon the admission crieteria of the club. If admission is open to all the owners of the park you also have legal right; otherwise go through the constitution of the corporate park.
