my client has purchased a resdential block he had bonafide made all the payment to the vendor and took possession of the block lastly he had made the remaining payment by a cheque of Rs. 9,000 within two days my client was informed by the society that the vendor had not paid muncipal taxes till the date of possession so my client had given instruction to stop payment & asked the vendor to clear the said amount the vender had not responded so my client has paid the said amount to the corporation from this event the vendor is also refusing to sign the necessary forms relating to transfer the said block in my clients name from which forum i can get easy redressal

From the consumer forum u can get. When vendor is failed provide necessary service to ur client, it amounts to deficiency of service. U can file complaint in the consumer forum against the vendor for not rendering better service.

Dear Jitendra
Your case is fit case to be filed before the Consumer Forum. However if matter pertains to co-operative society than in addition to consumer forum you can file the same before Co-operative tribunal.

In general Your case comes udner Consumer Forum and since the Co -Perative Society is involved , it is better to appraoch the District Registrar ( Co- Oerative ) for reddressal of your grienvance , in addition to the Consumer Form case .

Dear Jitendra:

Kindly clarify whether, the agreement of sale between you and the vendor contains the following clause:

The Vendor shall pay all outgoings, including ground rent, taxes, assessments, dues, duties, impositions and outgoings upto the date of delivery of the possession to the vendee and transfer of the building is complete.

If answer is affirmative invoke the clause by sending a legal notice to the vendor and wait for his reply. If the vendor does not reply positively then proceed legally.

Dear Jitendra, in my opinion you can not approach different forum at the same time with same prayer. So, you should decide first regarding the appropriate forum. If you have valid agreement you can go under THE SPECIFIC RELIEF ACT, 1963 and/or for creating a pressure you can lodge FIR.
