Collection of income tax on salaries and non salaries

Sir,
I on behalf of many Drawing & Disbursing Officer appointed under State Govt Service wants to know that under which constitutional provision the State govt is required to collect Income tax from its employees under Income Tax Act, 1961 ?
we presume that it is the responsibility of central govt employee and not that of State.
Further, if no tds return is filled in time that D&DO is to pay fine from his pocket whereas no any incentives is paid to us other normal salary equal to that other employees of the State also get.
So our main question is why hsould State govt employee do the duty pertaining to the Central govt.

Very Bad system.
Law never say:- Pay money on the work you are doing if in right path.

Being an Accounts Officer, it is quite a vague query on your part. It seems you are not aware of the accounting ystem in the Central and State Governments of India.

You may better read a Government publication, "Introduction to Indian Government Accounts & Audit," if not aware of the systems. Also, if you are an Accounts Officer with any State Government department, better ask the Chief Minister and the Finance Secretary of your state, why they share revenue of the Central Government through annual budgetary allocation and also additional financial support in several of their projects and calamities from time to time in addition to the fixed allocation of the tax money from the Central Government.

Now, about your statement, "I on behalf of many Drawing & Disbursing Officer appointed under State Govt Service wants to know," a vital question arises, who made you the representative of many Drawings & Disbursement Officers of your state, when you don't know the ABC of the revenue collection & accounting network of Government of India and the states?

I fully endorse the advice of Ld. Dhingra ji. Central and State Governments are working in the prescribed system as defined in Indian constitution wherein various duties which seem as of Central Government are performed by States and vice-versa. The collection of Income Tax is also further distributed among the States and Center as per formula which being an accounts officer should know more than me.

If an officer fails in its duty then definitely the provisions of penalty are imposed as part of disciplinary proceedings.

Also, if you feel, "Expert are expert for name shake only," why you raised your query before them? You could have gone to the topmost lawyer of India to ask your question for your full satisfaction. You can still do so.

I wonder, when you don't know the meaning of a simple word, "shake" and where that word can be used, what type of knowledge about accounts, finance & taxation can be expected from a person like you, as an "Accounts Officer?"

Evidently, he can be an "Accounts Officer" only for the name sake.

TDS / Deposit of TDS / issuing the certificate etc.provisions are governed by Income Tax Act which is an act by parliament having validity from constitution.
