Collectors approval for building construction in dombivali

There are many plots in the Thane, Dombivali, Ambernath area that are owned by collector. Owners staying in these plots have entered into development agreement with developers. Developers have started constructing the flats however, collectors approval has not yet received. Is there any risk for buyer to buy flat in these building? Can builder get completion certificate without collector approval? Is there any risk of not getting possession on time? Do buyer need to pay any penalty/ tax after taking possession to regularize the construction/ flat? Kindly advise. Thanks- MWR dombivali

do not purchase any such flats unless prior approval of collector is obtained . contact a local lawyer . obtain title clearance certificate and then only purchase the flats

NOC of the collector is mandatory which if not obtained ultimately can prove a havoc for the buyers so better to avoid purchase of such property.

To my expectation they are not plots, they are open lands converted from agricultural zone to residential zone. Hence, for open land, when there is transfer of property (by way of development, sale deed etc) collector permission is must. otherwise the sub registrar will not register the same. When the open land and the development agreement itself is in dispute, how can you purchase the same. You will not get title.

I endorse the views of experts, do not run a risk by buying such unapproved properties which may land you up in trouble and huge loss of money and peace, better consult a local advocate before venturing into purchase.
