Collusion between advocates

Hi,

I was married 13 years back and the filed for divorce on grounds of cruelty. I dont want her to get a divorce because she is planning to remarry and ruin my daughter's life in a new matriomonial home under a new husband, while making access to my daughter very difficult for me.

Yes, you can intervene and oust him at any time you desire. There is no legal bar. But why to take chance if you are so apprehensive. Better change the lawyer. It is not so that every lawyer is same. Rest, the contents of petition will ascertain whether cruelty is constituted on those facts or not. Why don't u move an application for custody as well. Kindly let me know if you need any further help.

Thanks for your response. Like I mentioned, I've no guarantee that the next lawyer won't also collude because the fee I pay will be fractional compared to what they can pay to buy him/her out.

I am also thinking of filing for custody but again my lawyer pretends he is very busy, and delays everything. I contacted a few other lawyers, but they are also weird in their own way. They try to make easy buck by encouraging me to settle out of court or ask me to bribe the court which I'll never do.

My case is in Hyderabad. I guess I can only take the services of those who practice there.

You can engage any lawyer practising anywhere in the country. Of course, fees would be commensurate with their professional standing and the efforts they need to out in.

Prima facie, it is felt that one should not be a 'doubting Thomas'. Unless one has cogent reasons, one should never doubt the integrity and impartiality of a Lawyer. If one goes on without having faith on the Lawyer, one can never get a reliable Lawyer of his/her satisfaction and it is better him/her to appear in person.

In the normal course, barring few dark horses, most of the Lawyers cannot be lured by money or other temptings once they take a case on hand. Moreover, they r bound by their Professional ethics which prohits them to be collusion with their opponents in a case.

Inspite of all the above, if you have a strong belief that your Lawyer is unreliable, you are free to change your Lawyer right now itself. In Hyderabad, there are large number of good Lawyers having fame and name for their honest and efficient handling of matters. If you are serious to find one such Lawyer, it will not be that difficult. Decide now.

I agree with the expert A.A.JOSE BARODA. Only a few lawyers go for collusion. Better change your lawyer right now.

It seems your wife is not interested in you any more. If you are interested in betterment of your daughter, better go for mutual consent divorce with custody of your daughter and let your wife move her own life. This would be better and practical situation for all.
