Compare sec 106 transfer of property act and rent control ac

I am residing in a municipality site. The third party created a document as if she purchased the said property issued notice under section 106 of Transfer of Property Act and and filed rent control case before the tribunal for evicting me as if i am her tenant. I have neither paid any rent to her nor any agreement between us. whether petition before rent control is maintainable or suit for eviction is required

Issuance of legal notice u/s 106 of the Transfer of Property Act is certainly based on title of the demised property, which is "out" of presumption of ownership of demised premises, which you are suspecting to be fake and I do not subscribe to your statement, discuss with a local lawyer.

Provisions of State Rent Control Act are attracted in your case or not, is a matter to be ascertained from the facts of case such as rate of rent, gazette notification qua area/locality the property declaring it within municipal limits etc.
