Querist : Anonymous (Querist) 22 June 2023 This query is : Resolved
Hello Experts,

I have sent a letter and a reminder to a notary practicing at Thane District for providing me details of a document notarised by her in the year 2013 as the same is produced now by the defendant in a court matter in the City Civil Court, Mumbai. I have mentioned entire fact of the matter and requested her to provide me the details. But she neither has provided the details nor even cared to reply to my letter and reminder letter.
I want to complaint against said notary for her non-co-operation. please guide me that where can I complaint against her in Mumbai and in Delhi and to whom can I address the complaint.

Sir,
I want the details about the concerned authority before whom I can complain and get the direction to provide me the details.

Complain to the licensing authority/Renewing authority. The licensing authority is at State Head Quarters and the renewing authority is at the regional/zonal authority of your area.

Notary public is not bound to respond you so if you make her complaint to any authority that will be ineffective better request to court to call for the details of document from notary.

You have no right or authority to get any document from Notary as per any law. So, asking for a document that she is not bound to give you is a sort of harassment. You sent a reminder too without having any legal basis.
And now you want to make a complaint against her, despite she did not violate any law in any manner and tarnishing her image by accusing her that she violated some law.

So, she can make a complaint against you for your unnecessary harassment aiming at something else.

Yes the notary can lodge a criminal complaint against you for harassing her.
The notary public is not yor servant neither she is bound by your dictates or there is any necessity for her to divulge with the information sought by you.
Recently, the High Court of Kerala has observed that no court shall take cognizance of an offence committed by a notary public in the exercise of his functions under the Act except when a complaint is made in writing by an authorised officer of State or Central government by special or general order
