IF THE COMPLAINT IS NOT FILLED WITHIN 45 DAYS OF RECEIPT OF INTIMATION THAT THE DEBTOR HAS REFUSED TO ACCEPT LEGAL NOTICE. CAN A COMPLAINT BE FILLED AFTERWARDS.

Dear Mr. Sameer,

This query has been answered by the experts umpteen times.Whether the notice is received or not you have to file within 45 days of the date of the notice.After 45 days you can place the circumstances for the delay before the Magistrate,but it is the discretion of the Magistrate to accept or not.
