i want to know ,the legal consequences if a husband is not intrested in having any phisical relation with wife.if a husband is depressed and not intrested in performing sex act,can land the husand and his family in trouble.
can any consuellor can for the husband to have sex with wife.

A husband may not be compelled by court to have sexual relations with wife.
In your case non performance of physical relation is not amounting to mental cruelty as the conduct of husband does not appear intentional.
Of course this case is not of impotency.
Circumstances not appears such which constitute irretrievable break down of marriage.
Looking at all the circumstances It appears no legal remedy with wife. God hep her. Pl seek more advise from expert advocates.

I agree with the view of Kiran. But if the husband refused to go for medical check up and continue with his failure to perform his marital duties it sure will amount to mental cruelty to the wife.

Better to contact good doctor. It is mental problem due to it may be hectic work or tension.
It is the duty of the wife to attract her husband, counseller advise does not works out.
I think due to this problem of the husband wife has also contributed.

From legal point-It could be ground of divorce from wife side but the onus is on her to prove that it comes with in the ingredient of clause under HMA-1955

Yogesh has came directly to the quarry. If husband is deliberately not performing sexual relations with his wife then it becomes a solid ground for seeking divorce a it is also a mental cruelty liable further DV Act but medical problem cannot become such ground as told by various experts.

Mr.Makkar is quite right, but as per my opinion, other counselers have only suggest that he should move to the doctor to solve this problem instead of taking any legal course.
Rest From the legal point, wife can initiate any legal proceeding for divorce or else. but as per my advice you should approach to the doctor to rectify this problem else your married life will become hell.

I agree with Mr Makkad.
Denial of conjugal rights amounts to inflicting mental cruelty. If the wife complains about this, it is punishable upto 1 year imprisonment.
