Construction of flat on terrace

Hi

I have a question regarding my flat in faridabad (haryana). Presently i have a flat in a building having 3 floors(ground,first and second floor).I have the full rights of the terrace as i own a flat on second floor. There are total 12 flats in the building. These flats were built by the builder on HUDA plots and were sold to individuals.

Presently all such buildings in the locality have 3 floors only. However, rumour is that permission has been granted by HUDA to build one more floor in the existing buildings.

I want to know ,if i have to build a flat on top of my terrace then ,do i have to take any kind of NOC from the ppl living on the first and second floor? What is the procedure for going abt this construction?

If you have given exclusive right over the roof including making future constructions then you need not take NOC from other.
So your deed of sale needs to be checked first.

yes at the time of executing the deed if you have mentioned in future you will construct some area then you can construct if you have not then you cannot construct

terrace forms part of common area . you cannot carry on any further construction on said terrace without approval of other members of the society . it is necessary to go through the provisions of agreement entered into by you for purchase of said flat to advise further

Why are you discussing a matter which is based upon rumours? If the policy by Haryana Development Authority shall be issued, it shall definitely contain the rules which may also contain the solution to your problem.
