Hello sir

I file a case in district consumer court due to non payment of Advance amount paid for site to Developer . The court in 2010 passed order in favour of me by directing the opposite party to refund the amount alongwith interest@18%.

Till date the opposite party have not paid be any amount. Further i think he has also not taken the order of the district consumer court. He is also ebsconding as he has closed his office and shifted his residence too.

1. Can any one suggest, what r legal remedies available to me in thiscase.

2.Can provide me the draft of Execution proceeding application
which is to be filed in the district court.

3.Any favourable judgements,if any in this case?

FILE THE EXECUTION OF ORDER AND APPLICATION FOR START PROCEEDINGS OF CONTEMPT OF COURT BY OTHER PARTY. NO NEED OF ANY JUDGEMENT.THE COURT WILL TAKE ACTION AGAINST YOUR OPPOSITE PARTY AT ONCE.

You aleady know the procedure to implement the order . So go and file the execution petition or take help of any locl advocate.

Am already file the execution. But court send notice to opposite party but Notice is returns back due to not available of OP. in the court judge ask me about amonther Address of OP. But We Dnt have any other Address. OP is totaly abscanding what i have to tell in next hearing in court, pls advice me

Then you did not put the right facts in your query.
In the original query you were asking for remedy as well as model execution petition whereas later on you are saying that you have already filed such petition.
Do not post such contradictory queries or ask for a thing which you already have.

unless,you know the correct contact details/whereabouts of the op,no fruitful action could be taken.

if the amount involved justifies,engage some private detectives to find out the present address.
