I entered into agreement with a builder for shop cum sco in a propsed mall. One year back I filed a police complaint against the builder. The complaint was filed without action. Can I now file a complaint in consumer protection act?

If the complaint is within the purview of the Act, then you can succeed to file in 2years.

CASUAL QUERIES CAN'T FETCH REAL SOLUTIONS.
So, instead of posting an academic question, better discuss the problem thoroughly with some expert by getting examined your case related papers, including the stated agreement?

It is not clear that you are a purchaser or landlord, as the case may be. Police complaint is separate issue, you can file a complaint case under section 12 of the Consumer Protection Act in District Consumer Forum if your claim is below Rs.20 lakhs. If your claim is above Rs.20 lakhs then you can file a case in State Consumer Commission.

There is no bar to file consumer complain even if earlier you filed criminal case against the builder but the facts of both the issues have to be taken care of which you are shying to disclose hence within our limitations set by you, we have given you best possible advice.
