Dear sir, I filed petition in HC to reduced the maintenance, got order to pay half of the district court order and 498a acquitted long ego.
Now her side pressurizing me for discussions and one time settlement, and I dont have any positive hopes on them. I suspect same story of huge money extract from me also it appears that they want me to tell in HC that I am ready for out of court settlement. My question is can I ask them to withdraw DVC and come for discussion instead of me telling in HC that I am ready for out of court settlement.

Settlement for divorce by mutual consent has to be based on , firstly withdrawal of all criminal/civil cases filled against each other in any court or before any authority, secondly the onetime permanent alimony and maintenance for wife to be paid in one or two instalment as the case may be and for giving undertaking not to file any case or complaint against each other and their parents/relatives or to defame each other in the society thereafter the settlement is being done. Your trust for the wife has gone and you want her to first withdraw all criminal complaints/cases against you before the settlement takes place, so you convey this to them. Tell that you will sit for final settlement only after they show positive side by withdrawing all cases/complaints against you pending in court or before any authority. If you have filled for divorce against her, that you will withdraw at the same time you file for divorce by mutual consent jointly with her.
