Coopting a member in a housing society

Querist : Anonymous (Querist) 03 November 2009 This query is : Resolved
I live with my mother in an ownership flat in Mumbai which is solely in her name. I am a nominee. She is keen to add my wife and my name to the share certificate during her lifetime. What is the procedure?

Also, is it true that I would have to pay stamp duty if my mother were to transfer the flat in our names during her lifetime?

Thank you

She has to apply for adding ur wife's name to the share certificateto ur society, there might be some prescribed form about that.
transfer of property amounts as equal to sale, so tell your mother to exeucte the gift deed or rights relinquish deed in your favour, which are not at all costly.about

You can also file a suit for declaration before civil court wherein you show a family settlement and get a decree for that. No much amount is required to file the suit. Then get this decree executed in each record wherein u want.
