Cousin tokk money for the flat but didnt transfer the ownership

i am staying in my brothers flat,it is a mahada flat,he has paid in full and final amount to mahada for the flat,i am staying from 2002 till date,my brother fooled my mother telling that he would transfer the flat in her son name,which he didnt do,but after my mother expired in 2010 he phoned me and told me to vacant the flat,then he tried to threaten me by telling real estate agent to call and threaten me,he has ready to pay me 7lakhs,he had taken 4lakhs in total in installment,250000 in 1990 and 150000 in 2002.i told him that now 1 gunta comes for 9lakhs and to built another 3lakhs, so i told him to give me 10lakhs which he didnt agree,then he left to newzeland he is an nri since from 2002,he later sent me a notice to vacant the flat or he will put a civil and criminal case against me and my wife,i sent him a email that i to will file a criminal case of cheating against him and all the people who are involved his brother and brother in law also and friends to,so now he is confused what to do,my laywer told me let him put the case then we will put against him and in our case he will have to come down from newzeland..............can mahada take action against me,or can they tell me vacant the flat in any way,my cousin has taken the money for the flat, and i have a ration card,election card, since from 2002 and i am paying the bills with my cheques also building maintance,light bills,he had come down in the month of april 2011 the compalin was just to inform that he gave me the house to stay in 2003 since i didnt have a house to stay and he ran to newzeland without informing,when i gave a complain about the threatening call then the cop told me that my cousin also had put a complain against me,so i told that cop that you should have called me in front of my cousin brother and then the truth would have come out,i have got my cousin written complain statement through RTI....only the thing that is bothering me is that can mahada interfer in this matter in any way or no........or the society also please help me and guide me,i am a poor family person,i am the only earning member in my family, i have no support from any one, i am just stuggling all around.........thank you
i have some call recording while speaking to him on the mobile,video recording also where he has admitted that he took the money....will this help me in the court
