Credit card dues & limitation act

I owed a Credit Card of a Pvt. Bank & used it in Jan 2008. after that I realized that I would not be able to pay it. I changed my all personal detail like (number , email id, DOB, address everything).. In 2012 I joined a company where my employer opened my salary account in same bank & i provided the new personal detail to bank. Every thing was going good ..

Suddenly in Mid-May2016, Bank put Credit Card Lien on my salaried saving account. When I inquire, they said My Namae, My Father Name & My Signature is matching.. I denied that I never owed this card & none of my other detail is matching to it.

What Should I do now or what may bank can do this legally ?

If you have borrowed you should pay.

Changing DOB? How could you make it possible? It is felt that such change is illegal!


The debt if not admitted since 2008, might be hopelessly time barred.


However you may have to exert the get lien vacated on legitimate grounds.


You have posted that:"I denied that I never owed this card & none of my other detail is matching to it."

Did you state so in writing?


Engage an able counsel and get out of the mess that is your own doing.

You are playing fraud upon the bank and you are expecting us to help you to do this.

You have taken money from bank and you must repay the debt.

This is only piece of advice from my end.

The bank has tapped you.

"I denied that I never owed this card & none of my other detail is matching to it."

If you have state so in writing/on record you have passed merits.

If you have changed DOB you have committed illegality.

The lien has been marked.

Author, if you want to get out of the mess that is your own doing, find a good lawyer for you and be willing to pay as well.

If I accept that I am the same person.. Will limitation act work on this ?

Depends upon how the bank cultivates and presents the facts.


In any case the lien has been marked and onus is transferred on you and it is you now who will appear to get it vacated.


Approach a very good counsel and let your counsel.................counsel you wisely.
