Dear All,
A govt employee [ now retired ] can have a Below Peverty Line Ration card on his name who is earning a salary of 15000/- pm @ time of getting a ration card?
If so, any criminal liability applicable against him?
The information came into light after filing an RTI.

he is guilty of defrauding the govt . draw the attention of rationing authorities of your state to the fraud played by govt employee .
BPL card is only for the poorest of poor and not for salaried govt employees .

Such ex.employee is required to be punished but it can be done only by officials of foods and supply.

You cannot do anything on your part, except to report the matter to the food & supplies/ rationing department for rectification of mistake. However, if the employee Government has intentionally tried to cheat by showing his income below poverty line, only the rationing department, if like can sue him for defrauding the department.
If the fault lied on the part of the rationing department for wrong issue of card, only the concerned dealing asistant & suprvisor of the department can be held responsible.

Here the scenario is very different. As for example, Scholarship is given to the students whose parents are below One lakh, but even those officials who are earning not less than 30 to 40 thousands per month are getting scholarships leaving aside their ration cards which is meant for families below the poverty lines. Time to address this parctcices, as a social problems.

I think we should steer clear from value judgments or talking about the (im)morality of it, the action clearly falls foul of law, The offence is cheating.
