Criminal Writ petition

Ld Counsels,

Is it possible to file a writ petition under Art.226 & 227 praying for disciplinary action against police for fabricating the records of criminal case and to quash the criminal proceedings instituted out of such malafide intensions.

Kindly clarify.

Also kindly clarify the difference between criminal writ petition and writ petition.

Dear Anonymous,

Yes you have a right to move to the High Court against the police official by way of a writ petition but for the purposes of quashing these proceedings you have to approach by a separate petition u/s 482 of Cr.P.C.
